    The Department of Industrial Accidents (DIA) mission is to administer the Commonwealth's Workers' Compensation System and to provide prompt and fair compensation to victims of occupational injuries and illnesses, and to see that medical treatment to injured workers is provided in a timely manner while balancing the needs of employers to certain workers' compensation insurance costs. The DIA is seeking an attorney to assist the agency’s General Counsel in bringing civil and criminal actions to the courts of the Commonwealth. All attorneys hired, through the General Counseland their designees, will be appointed as Special Assistant Attorneys General to file actions on behalf of the D.I.A. for criminal/civil court proceedings against employers violating the mandatory insurance coverage requirement of M.G.L. chapter 152. Counsel will represent the Workers’ Compensation Trust Fund in claims brought against it under Section 65 and in reimbursement matters under Sections 35C, 37, and 37A, appearing for the Worker’s Compensation Trust Fund at conciliations, conferences, hearings and appeals before the division of Dispute Resolution. The incumbent will assist the agency’s General Counsel in defending actions against employers who operate without Workers’ Compensation insurance in violation of M.G.L. chapter 152; to initiate civil proceedings in Superior and District Court to recover funds expended for injured employers of such companies; and to assist the General Counsel, in accordance with M.G.L. chapter 23E Section 10, to represent the DIA and the Workers’ Compensation Trust Fund. Duties also include, but are not limited to: * Preparing briefs, evidence, and case files. * Interviewing and preparing witnesses for trial. * Undertaking depositions and preparing affidavits. * Coordinating the activities of the Trust Fund Investigation Unit. * Coordinating all activities with other Counsel. * Conducting ongoing training for in-house staff. * Consulting with the Office of the Attorney General. * Consulting with the Office of the District Attorney on criminal actions * Drafting correspondence, reports, etc. as required. * Negotiating agreements and settlements, subject to General Counsel authorization. *First consideration will be given to those applicants that apply within the first 14 days.* *MINIMUM ENTRANCE REQUIREMENTS: *Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.
