The Idaho Transportation Department has an opening for a Hearing Officer in Boise. This position will conduct Administrative License Suspension hearings and it requires a deep knowledge of Idaho Code, rules and federal law. The incumbent in this position must be able to explain legal standards, elicit testimony and argument, and provide rulings on the admissibility of evidence and objections. After hearing a case and reviewing the associated documents, testimony, arguments, law and other relevant decisions, the position must create a written decision formatted as a Final Order for the Department applying legal format and legal requirements with decision making being a key factor in the written order.
NOTE: A criminal background check is required before a final job offer is made.
Example of Duties
PRESIDE OVER ADMINISTRATIVE LICENSE SUSPENSION HEARINGS:
+ Analyze case files upon request for an administrative hearing.
+ Identify issues and parties involved and determine the need for additional information.
+ Create and maintain a formal record of the hearing.
+ Record hearings in accordance with statute and rules.
+ Administer oaths and rules on admissibility of evidence. Review requests and issue subpoenas for relevant evidence.
+ Review and determine appropriate actions on requests for stays, continuances, dismissals, and postponements.
+ Elicit relevant testimony and argument. Interject and conduct cross-examination when necessary.
+ Be knowledgeable of and appropriately apply Idaho Code, Administrative Procedure Rule and Standard Operating Procedures.
+ Remain unbiased and treat all parties to the proceeding fairly and with respect.
ADMINISTRATIVE HEARING DECISIONS:
+ Issue Final Orders for the Department in the form of Findings of Fact and Conclusions of Law and Order.
+ Analyze documents for conformity with statutes, rules and regulation.
+ Analyze sworn testimony and other evidence for relevancy.
+ Interpret and apply pertinent sections of state and federal laws, IDAPA Rules, standard operating procedures, analytical methods for evidentiary testing and other procedures and regulations regarding evidentiary testing and the withdrawal of driving privileges.
+ Research and study applicable state and federal court decisions.
+ Write Findings of Fact and Conclusions of Law and Order for each administrative hearing that is held. State the final outcome/decision. Include facts, rules, procedures, statutes, and case law to support the final outcome/decision.
+ Maintain records and reports of the hearing including evidence, testimony and actions taken.
TECHINICAL ASSISTANCE:
+ Instruct staff in preparing Legal Discovery Packets, issuing subpoenas, admitting exhibits into the legal record, and answer questions.
+ Provide and explain technical information concerning hearing procedures, laws, rules and regulations to the public, law enforcement and government officials.
+ Recommend rule and statutory changes to clarify or correct deficiencies.
+ Discuss and evaluate similar cases with other hearing officers to ensure uniformity in application and interpretation of statutes, rules, regulations and case law.
MOTIONS AND OBJECTIONS
+ Review and determine appropriate actions on motions and objections to the Administrative License Suspension proceeding and/or decision.
+ Know, understand and apply appropriate rules and regulations to properly respond to motions and objections.
+ Issue orders ruling on the motions and/or objections.
ASSIST AND TRAIN OTHERS
+ Answer questions and provide input to other Hearing Officers to assist them with arguments and decisions.
+ Assist and educate law enforcement officers, attorneys and self represented litigants in the various facets of the Administrative License Suspension processes.
Minimum Qualifications:
Some knowledge of:
+ Administrative hearing procedures Rules of evidence and due process.
Experience:
+ Interpreting and applying laws, regulations and guidelines
+ Analyzing and evaluating facts, legal documents and records and drawing conclusions
+ Preparing written statements of fact and conclusions
+ Questioning individuals to elicit facts
MQ Specialties: Experience interpreting and applying state and federal laws pertaining to motor vehicle codes.
