    Position Specifics:

    This position will serve as Assistant General Counsel for DFA and will provide legal advice on various legal issues affecting the agency to ensure compliance with relevant laws and rules in its operations. The position will represent the agency in various litigation and administrative matters, oversee and assist with ongoing legal disputes, and coordinate with internal and external attorneys representing the agency in litigation and other matters, including without limitation requests under the Freedom of Information Act, EEOC matters, wage garnishments, and unemployment claims. The position will oversee the drafting, review, and negotiation of contracts and agreements entered by the agency. The position will provide legal guidance on employment-related matters, including the DFA Employee Handbook, DFA Policies and Work Rules, employee training, and resolution of employee grievances. The position will monitor and analyze new court decisions, legislation, and rules affecting the agency as well as assist in the drafting of proposed legislation and agency rules. This position will supervise and delegate work to other DFA staff members.

    Summary

    The Managing Attorney is responsible for conducting legal research and writing legal documents for use in litigation, providing legal assistance to the agency, and supervising subordinate attorneys and legal administrative support staff. This position is governed by state and federal laws and agency/institution policy.

     

    Functions

     

    Supervises and manages support staff and subordinate attorneys by interviewing, hiring, providing training, assigning workloads, and evaluating performance of incumbents. Provides legal services and advice to management and divisions on a broad range of matters. Represents the agency in negotiations. Represents the agency in litigation including all administrative and court proceedings. Interprets and analyzes all state and federal laws. Drafts new or revised policy and legislation. Conducts legal research. Drafts and prepares legal briefings and pleadings and responds to subpoenas. May develop and prepare budgets. Performs other duties as assigned.

    Minimum Qualifications

    Licensed to practice law and admitted to the Arkansas State Bar. ACA 16-22-201. The formal education equivalent of a law degree from an accredited law school; plus six years of experience in law, including three years in a supervisory capacity. Additional requirements determined by the agency for recruiting purposes require review and approval by the Office of Personnel Management. OTHER JOB RELATED EDUCATION AND/OR EXPERIENCE MAY BE SUBSTITUTED FOR ALL OR PART OF THESE BASIC REQUIREMENTS, EXCEPT FOR CERTIFICATION OR LICENSURE REQUIREMENTS, UPON APPROVAL OF THE QUALIFICATIONS REVIEW COMMITTEE.
