Job Description:
The Johnson & Johnson Law Department is recruiting for a Senior Patent Counsel, to be located at its MedTech location in Irvine, California.
This Senior Patent Counsel role will support J&J MedTech's Electrophysiology business in Irvine, California, and will play a crucial role in driving innovation and protecting intellectual property across a range of emerging and established Electrophysiology platforms, including J&J's cardiac ultrasound imaging platforms (e.g., the SOUNDSTAR® and NUVISION™ 2D and 4D intracardiac echocardiography catheters); delivery systems, including sheaths, guides, and transseptal access devices; and structural heart devices, including the left atrial appendage LAA) closure device and delivery system.
The attorney will work closely with multiple R&D teams and business leaders located at J&J MedTech's Irvine headquarters and at the Laminar site in Santa Rosa. The role will also require coordinating support efforts with R&D and team members in Israel, who provide IP legal support for systems, software, and other capital equipment associated with related Electrophysiology platforms. The role will also have responsibility for mentoring/training an on-site patent liaison as they develop capabilities in the areas of competitive intelligence; patent marking; invention disclosure mining; and patent portfolio pruning.
The attorney will also collaborate with Global Strategic Marketing to ensure that IP protection strategies align with product marketing plans and to stay apprised of business's strategic direction and emerging competitive technologies. Finally, the role will also be responsible for identifying IP assets for potential enforcement and protecting J&J MedTech's interests in this increasingly competitive area.
The position will report to the Group Leader for Electrophysiology & Neurovascular (Assistant General Counsel - Patents). The successful candidate will be required to work on site in Irvine, California at least 3 days/week.
Responsibilities:
• Developing and managing the patent portfolio of key business partners, including preparation and prosecution of patent applications around the world.
• Conducting freedom-to-operate analyses in support of new product development.
• Drafting and negotiating sophisticated IP, research, product development, and other agreements.
• Provide due diligence support for business development activities.
• Counseling senior business leaders and other collaborators on complex legal and business issues.
• Develop in-depth knowledge of the technology, commercial model and competitive strategies, and patent landscape for J&J MedTech Surgery. Developing in-depth knowledge of the technology, commercial model and competitive strategies, as well as the patent landscape, for other MedTech companies as needed.
• Have superior knowledge of competitive technologies in Electrophysiology.
• Support US and OUS litigation, including identifying opportunities to enforce patent rights.
• Manage outside counsel.
• Deliver regular presentations and interact with the business about patents, other intellectual property, contracts, and due diligence matters.
• Provide training to business personnel on patents, intellectual property, and contractual matters.
• Work closely and collaboratively with senior R&D teams and commercial leaders and colleagues, in an independent way, including influencing business decisions at a strategic level.
• Assisting in driving IP department growth and the development of Global Legal Organization colleagues, including providing mentoring, leadership and guidance to legal colleagues.
• Leading role in influencing public policy on IP related issues through engagement with IP and legal organizations and trade associations.
Required Qualifications
• An undergraduate or advanced degree in Electrical Engineering, Mechanical Engineering, Computer Engineering or Biomedical Engineering is required, with a degree in Electrical Engineering or Mechanical Engineering preferred.
• A Juris Doctorate from an accredited law school is required.
• Admission to practice before the USPTO and licensed to practice in at least one state or the District of Columbia is required.
• A minimum of ten (10) years of law firm or corporate law department experience is required.
• The ability to articulate and positively engage clients and internal partners is required.
• The ability to give well organized and thoughtful presentations to upper management is required.
• A demonstrated competency in electromechanical, mechanical arts, and combination technology systems used in healthcare technology systems (e.g., systems including software, algorithms, software, and device inter-connectivity) is required.
• In-depth understanding of patent law, including understanding of patent strategies, portfolio management, and competitive patent analysis is required.
• Ability to independently handle patent preparation and prosecution experience is required.
• Ability to independently conduct patentability and non-infringement studies is required.
• Travel up to 15% both domestically and internationally is required.
Preferred Qualifications
• A demonstrated background in medical devices is preferred.
• Experience in due diligence activities, license/agreement drafting, and negotiation is required.

The anticipated base pay range for this position is :
$173,000 - 299,000USD
Additional Description for Pay Transparency:
The Company maintains highly competitive, performance-based compensation programs. Under current guidelines, this position is eligible for an annual performance bonus in accordance with the terms of the applicable plan. The annual performance bonus is a cash bonus intended to provide an incentive to achieve annual targeted results by rewarding for individual and the corporation’s performance over a calendar/performance year. Bonuses are awarded at the Company’s discretion on an individual basis. Employees and/or eligible dependents may be eligible to participate in the following Company sponsored employee benefit programs: medical, dental, vision, life insurance, short- and long-term disability, business accident insurance, and group legal insurance.
