This new cabinet-level agency brings together programs centered on children and families, including child care and early learning, child support, child safety and permanency, economic support and food assistance, and youth opportunity. The new Department of Children, Youth, and Families (DCYF) Agency became effective on July 1, 2024.

The DCYF General Counsel’s Office is hiring a Data Privacy Official. This position serves as the Data Privacy Official for the entire Department, overseeing the development, implementation, maintenance of and adherence to privacy and security policies and procedures regarding the permitted and safe use of protected data, including protected health information (PHI) and other highly regulated data, in compliance with federal HIPAA, IRS and Social Security Administration requirements and state law. Serves on an agency-wide strategic oversight and planning committees, including the cross-agency data governance team.
Responsibilities include:
+ Provide strategic guidance, legal advice, and subject matter expertise on privacy and security law and data governance and compliance initiatives and issues across the Department and in partnership with MNIT, other state agencies, and Department partners and contractors.
+ Manage the work of the Privacy Office and provide timely and accurate legal support and advice to Department executive management, managers, directors, and staff on complex legal issues related to privacy and security matters.
+ **Develop and deliver legal training to Department management and staff on a variety of legal topics to ensure that Department staff understands their responsibilities under applicable laws.**
+ Provide legal support, including analysis, advice, and resolution to the Department management and staff in responding to data requests and data security incidents.
Minimum Qualifications

+ JD degree from an ABA accredited law school;
+ Current license and in good standing to practice law in Minnesota;
+ One (1) year of experience in a leadership role;
+ One (1) year of experience with data privacy and security;
+ Five (5) years of experience as a practicing attorney (up to one year of which may be as a judicial clerk). Experience must demonstrate the following:
+ Experience developing legal strategies and providing legal advice to executive legal leadership.
+ Experience with the legislative process and federal and state laws.
+ Litigation experience, which may include direct litigation experience, judicial clerking, and case adjudication as a criminal, civil, or administrative law judge.
Preferred Qualifications
+ Two (2) or more years of experience with the Minnesota Government Data Practices Act and/or other privacy laws;
+ Experience in developing and managing internal policies and procedures for handling data;
+ Experience planning and delivering complex legal training to non-legal audiences;
+ Knowledge and understanding of electronic databases, web applications, and information systems and their intersection with data privacy and security
+ Variety of experiences working effectively with others from different backgrounds and cultures.
