    The General Counsel is a senior level manager within the Massachusetts Gaming Commission. This positionoverseesthelegaldepartmentandprovidesdirectionandcounselonalllegalmattersrelatedto the oversight, regulation and administrationof casino gaming, sportswagering, horseracing, parimutuel and other related activities of the Commission. The General Counsel advises the development of Commission policy initiatives as well as provides guidance for legal issues that arise daily and require technical and accurate, research analysis and expedient response.The General Counsel provides legal expertise in the development and implementation of new and existing regulations and policies pertaining to gaming licenses, regulating casinosandsportswageringinitiatives.TheGeneralCounselisresponsiblefortheongoingdevelopment and management of the Commission’s legal team ensuring its commitment to providing sound, thoughtful, and ethical legal advice. *KeyDutiesandResponsibilities:* * AdvisetheCommissioninensuringlegalcompliancewithallstatelawsandregulations,specifically MGLchapter23K (casinogaming), chapter23N(sports wagering)chapter128A (horse racing), and 205 CMR (the Commission’s regulations), as well as open meeting laws; state conflict of interest and ethics laws; procurement rules and regulations; legislative process, state finance law and agency policies, and human resources. * Establish,manageandoverseestrategicandoperationalplansforthelegaldepartmenttosupport the Commission's existingandexpandingactivities,anddevelopandmanage systems for ensuring compliance with the Commission's statutory reporting requirements. * Direct and oversee the delivery and management of all legal services, including analyzing laws, rules, regulations andexisting and proposed legislation affecting the Commissionrelativeto the Gaming, Sports Wagering and Racing industries; drafting and promulgating Commission regulations related to gaming, sports wagering, and racing; managing the Commission’s adjudicatory hearing and public records programs; managing and consulting with private and publicsectorlegalentitieswithinandoutsidetheCommonwealthwhoprovidelegalservicesfor the Commission; and reviewing all significant transactions and contracts for compliance with Federal, State and Municipal laws and regulations. * ManageandadviseonlitigationimpactingtheCommissioninanyvenue,includingadministrative matters such as workers compensation, unemployment compensation and matters before the MCAD.This includes management of outside counsel as needed. * Directthedevelopmentofbudgetsandprioritizeexpendituresforthedeliveryoflegalservicesto the Commission, including internal staffing and outside counsel costs. * Providelegalexpertiseandguidanceconcerningbargainingunitcontracts,employeerelations, progressive discipline and other personnel matters which may arise. * Advise the Commission in interacting with other Commissions, agencies, and departments to coordinate common legal agreements, memoranda of understanding, interagency agreements, grants,commonwealthinformationstatementsandothercommonoperatingrulesorpractices. * AdvisetheCommissiononethicscomplianceandassistinpreparingandfilingnecessarydisclosures. * AdvisetheCommissionontheevolvinglandscapeofgaming,sportswagering,andhorseracing laws both globally and domestically. ManagementSkills: * Demonstratedabilitytoleaddiverseteamsandfosteracollaborativeandinnovativeworkenvironment. * Strongverbalandwrittencommunicationskillswiththeabilitytoengagewithinternaland external stakeholders. * Experiencewithandknowledgeofadministrativelaw,Massachusettsgovernment/legislative process and investigations and litigation.Gaming industry experience a plus. * Demonstratedcapacityforsoundlegalanalysis,legalreasoning,problemsolving,andlegal research skills. * Abilitytoworkinahighlyregulated,multi-stakeholderenvironmentandtocontribute meaningfully to an agency-wide risk and compliance culture. * Experiencewithmanaginglegalteams,developingandmentoringstaffandprovidingdirectionto achieve organizational goals. * Commitmenttointegrity,transparency,andpublicservice. The MGC offers a hybrid work environment and requires senior staff to work at least three days in the Boston Office. The successful candidate must pass an extensive background check conducted by the Massachusetts State Police. It includes a full credit check, CORI (Criminal Offender Record Information), fingerprinting, drug test, reference checks, review of IRS Income Tax Transcripts for the last four years, and a Certificate of Good Standing from the Massachusetts Dept. of Revenue (DOR). The Massachusetts Gaming Commission is responsible for the implementation of the expanded gaming law (Chapter 194 of the Acts of 2011) and regulatory oversight of G.L. chapter 23K (casino gaming), chapter 23N (sports wagering), and chapter 128A (horse racing). Under these laws, the Commission is tasked with establishing a regulatory framework for the solicitation, licensing, taxation, and oversight of a maximum of three casino licenses and one slots parlor only license, the provision of in-person and digital sports wagering, and the live and simulcasting of horse racing in Massachusetts.
