Their work is grounded in the Individuals with Disabilities Education Act (IDEA) and Section 504 of the Rehabilitation Act.

    What They Do:

    + Represent families in matters involving:

    + Compensatory services for missed school-mandated supports

    + Due Process Complaints (DPCs)

    + Independent Educational Evaluations (IEEs)

    + Settlement negotiations, tuition reimbursement, guardianship, and special needs trusts

    + Engage in class action litigation, including:

    + A federal class action filed in July 2020 on behalf of students with disabilities impacted by school closures during COVID-19

    + State-level class actions in New York, New Jersey, Massachusetts, California, and other jurisdictions

    Position Summary:

    Reporting to the Director of Federal Litigation and/or the Director of Special Education Practice, the Senior Litigation Attorney will be responsible for a wide range of litigation-related activities with a strong emphasis on legal writing and research. The role involves federal litigation and administrative advocacy in jurisdictions across the United States. A key example of the organization's work includes the only national class action lawsuit addressing the rights of special education students during COVID-related school closures.

    Reports to:

    Director of Federal Litigation and/or Director of Special Education Practice

    Key Responsibilities

    + Conduct extensive legal research and produce high-quality legal writing.

    + Draft and review legal documents including, but not limited to:

    + Complaints

    + Interrogatories

    + Discovery demands

    + Orders to Show Cause

    + Motions for Preliminary Injunctions

    + Motions for Summary Judgment

    + Appellate Briefs

    + Prepare and participate in court appearances, including oral arguments before District Courts and Courts of Appeals.

    + Represent clients in administrative hearings related to special education matters.

    + Assist or mentor junior staff attorneys in litigation preparation and proceedings.

    Requirements

    Required Qualifications

    + Admission to the New York State Bar and to the Southern and Eastern Districts of New York (SDNY/EDNY).

    + Minimum of seven (7) years of progressively responsible litigation experience in the United States, including practice in SDNY and/or EDNY.

    + Outstanding legal writing and research skills.

    + Strong analytical and organizational abilities.

    + Excellent communication and interpersonal skills.

    + Demonstrated understanding of relevant federal and state disability laws.
