The **Senior Division Counsel, Emergency Care,** is primarily responsible for proactively handling a broad range of legal and compliance matters associated with the Emergency Care business unit within the global Medical division, including working closely with business unit leadership, functional partners, and outside counsel on a variety of critical matters for the division.
Essential Duties & Responsibilities:
+ Serve as a member of the Emergency Care leadership team as the leader of the Emergency Care Legal function; serve as a trusted advisor to the Emergency Care VP/GM and other senior leaders
+ Serve as the “point person” for all legal issues related to the Emergency Care Business Unit and provide legal advice and counsel to BU members as needed in a highly regulated environment
+ Bring a solutions-oriented approach to solving complex issues, prioritizing multiple workstreams, and coordinating across functional groups to advance business objectives, resolve disputes and promote the growth of the division
+ Provide analysis and timely counsel on legal, regulatory and compliance issues, including with respect to litigation, medical device regulations, intellectual property, employment, mergers and acquisitions, data privacy, competition law, AdvaMed, anti-kickback, FCPA and other anti-corruption laws
+ Work together with business leaders on strategic planning
+ Independently draft, review, negotiate and advise on a variety of agreements (e.g., sales, services, supply, distribution, consulting, clinical study, non-disclosure, employment, and other commercial arrangements)
+ Analyze and provide clear and concise guidance on laws, rules, regulations, and Stryker policies as necessary, including with respect to the company’s interactions with healthcare professionals
+ Collaborate with lawyers and other professionals from Stryker’s Centers of Expertise to manage a variety of significant matters (e.g., strategic contracting, data privacy and security, intellectual property, litigation, employment, and regulatory matters)
+ In close collaboration and partnership with Emergency Care Compliance, provide timely legal advice and counsel on compliance issues, including matters related to interactions with healthcare professionals, AdvaMed, investigations, ethics and code of conduct violations, company policy infractions, US anti-kickback law, and other anti-corruption laws
+ Assist in managing litigation and pre-litigation disputes with support from the in-house legal team and outside counsel
+ Review marketing, promotional and scientific activities and related materials for compliance with Stryker policies and applicable laws and regulations
+ Seek to streamline and continuously improve legal and compliance services across the organization
+ Partner closely with the compliance team to assist in managing a robust compliance program to address key risks
+ Provide in-house training and education to business stakeholders to enhance awareness and understanding of applicable laws, regulations and Stryker policies
+ Provide leadership, mentorship and training to direct report(s).
Education & Special Trainings:
+ Juris Doctorate (J.D.) with strong academic record
+ Admitted to the bar of at least one state
Qualifications & Experience:
+ Ten years or more of applicable professional experience, preferably with increasing levels of responsibility; prior in-house experience is valuable but not required
+ Strong judgment, communication skills, professional demeanor and business acumen
+ Ability to work effectively across functions (e.g., regulatory, finance, human resources, operations, supply chain, manufacturing, R&D, sales and marketing), Stryker divisions, and geographies
+ Comfort interacting with business leadership and responding to time-sensitive inquiries on a regular basis
+ Ability to work in a highly collaborative environment and build relationships of trust with key stakeholders
+ Strong analytical, drafting, and interpersonal skills
+ Demonstrated commitment to integrity and accountability
+ Experience providing legal advice in a highly regulated environment, preferred but not required
+ Has a general understanding of business financials and reporting
+ Has the ability to allocate resources effectively and, where relevant, has a general understanding of the budgeting process, expense and headcount management.
