    SUMMARY OF POSITION:

    The Director of Compliance and Privacy (Investigation and Guidance) will report directly to the Vice President of Compliance and Privacy and will provide oversight and strategic direction to the organization's compliance and privacy program while serving as a role model for ethical management behavior. The individual selected for this role will be a seasoned, transparent, and collaborative compliance leader within the healthcare industry and will be responsible for developing, implementing, and managing regulatory compliance oversight and internal compliance audit across Penn State Health. Network and performance strategies are focused on the post-acute care facility continuum of care including but not limited to Skilled Nursing Facilities (SNF) and inpatient rehabilitation facilities (IRF) and home health agencies (HHA). External partners will be SNF, IRF and HHA.

     

    **ESSENTIAL DUTIES:** The percentage of time spent performing essential functions is 95%. Qualified individuals must have the ability (with or without reasonable accommodation) to perform the following duties:

    + Promote a corporate culture that fosters ethical and compliant behavior and provides the basis for ensuring adequate internal controls and compliance with all laws and regulatory requirements.

    + Work with internal and outside counsel, executive management, and entity leadership regarding compliance risk areas.

    + Participate in the visioning and strategic identification of new enterprise risk advocacy, legal requirements, risk management, and audit processes.

    + Develop and lead the execution of system-wide compliance and privacy work plans focused on assessing and enhancing internal controls and adhering to compliance regulations.

    + Direct the full life cycle of the compliance audit and administration processes, including policies, Code of Conduct, Notice of Privacy Practices, investigations, issue resolution, remediation and mitigation including identifying corrective action, ongoing monitoring, training/education, and guidance.

    + Coordinate, supervise, and perform medical record audits of electronic and manual documentation, coding, and billing for technical and professional services.

    + Develop formal audit reports of findings and recommendations, which are presented to senior management of applicable department, the Compliance Committee, and the Audit and Compliance Committee of the Penn State Health Board of Directors.

    + Conduct close-out meetings with senior management of applicable department and perform follow up to ensure management completes all recommended/corrective actions identified through audits.

    + Coordinate audit activities with Internal Audit, as necessary.

    + Draft, review and negotiate contractual terms and conditions within agreements with internal and third parties with respect to regulatory requirements, as well as privacy and compliance initiatives, including Business Associate Agreements.

    + Anticipate and manage potential business risks, ensuring strong stewardship and management accountability at all levels.

    + Identify compliance risk areas and develop action plans accordingly.

    + Represent the organization's interests with external parties.

    + Participate in external government audits.

    + Participate in development of voluntary disclosures and repayments to federal and state agencies.

    + Leads a team of Compliance specialists and oversees day to day tasks, Is responsible for performance evaluations, timekeeping, disciplinary actions and hiring of these team members

    MINIMUM QUALIFICATION(S):

    + Bachelor's degree

    + Minimum ten (10) years experience in comprehensive compliance, audit, billing, coding, and documentation experience, preferably in complex health care system.

    + Minimum five (5) years experience in managing, guiding, mentoring, and motivating a team in a complex organization with demonstrated skills in developing strong, collaborative teams.

    PREFERRED QUALIFICATION(S):

    + Advanced degree

    + Coding certification (e.g., CCS, CPC, RHIA, RHIT)

    + Certified Internal Auditor (CIA)

    + Professional privacy certifications (e.g., Certified Information Privacy Professional (CIPP), Certified Information Privacy Manager (CIPM), etc.)

    + GDRP or other international or privacy experience

    + Strong skills in network and business development, managing the relationship of health care business across various care settings
