    Job Description

    The Bronx District Attorney’s Office is seeking a well-qualified Counsel to the Investigation Division with demonstrated ability to serve the 1.5 million members of the Bronx County community in pursuing a safer Bronx through fair justice. The Counsel for the Investigations Division serves as a senior legal advisor and support resource to the Division Chief, Deputy Chief, and various bureaus within the Division. This role involves providing expert legal guidance, reviewing and enhancing the quality of investigations and legal filings, and ensuring compliance with statutory, procedural, and ethical standards across a broad range of criminal matters.

    Job Responsibilities:

    Work collaboratively, and maintain consistent communication, with the Division Chief and Deputy Division Chief to identify and address legal concerns that arise within the Division.

     

    Provide legal and practical counsel and assistance to the Chief and Deputy Chief of the Investigations Division, as well as Division Managers, line ADAs, and Professional Staff assigned to the

     

    Financial Frauds Bureau, Public Integrity Bureau, Special Investigations Bureau, Rikers Island Prosecutions Bureau, and Violent Criminal Enterprises Bureau.

     

    This necessitates having an ongoing expertise and appreciation of the statutes and case law related to the penal law (including but not limited to conspiracy, financial crimes, narcotics, public integrity, contraband, enterprise corruption, firearms and violent felony offenses), criminal statutes located outside of the penal law (such as Corrections Law, Election Law, Animal and Markets Law, Education Law, Business Law, and Vehicle and Traffic Law), criminal procedure law (including but not limited to grand jury, discovery, and speedy trial), evidentiary rules, obtaining digital evidence (subpoenas, search warrants, pen registers and trap and trace devices, GPS, Cell Site Location Information, and the federal Stored Communications Act) and eavesdropping warrants (Article 700).

     

    Ensure compliance with statutory requirements in obtaining and executing eavesdropping warrants.

     

    Assist members of the Investigations Division in developing and progressing investigations while abiding by ethical rules and following best practices.

     

    Review motion practice and warrant applications within the Division to ensure quality filings and assist line ADAs to further develop writing skills.

     

    On a regular and ongoing basis, provide input regarding best practices and protocols for the Investigations Division, and participate in their implementation.

     

    Help develop, implement, and institutionalize (or further develop, implement, and institutionalize) special projects and initiatives within the Investigations Division and office-wide.

     

    Provide expertise and counsel in matters that may have significant impact on the Investigations Division or legal issues frequently encountered by the Division.

     

    Represent the Investigations Division in the “Motions Committee” Meetings and other office-wide committees, including but not limited to IT initiatives and U-Visas.

     

    Collaborate with other Division Counsels to maintain consistency in our practices, such as those related to grand jury, motion practice, search warrants, discovery, and speedy trial.

     

    Develop and conduct Continuing Legal Education lectures within the Division and office-wide.

     

    Develop and update templates while coordinating with other Division Counsels and the IT Department.

     

    Participate in interagency collaboration on Investigations Division matters.

     

    Represent the Office in meetings with outside agencies as needed.

     

    Work collaboratively with people inside and outside the Office on legislative matters that affect the Investigations Division.

     

    Consistent with the other Counsels and other Managers in the Office, provide on-call Supervision to felony on-call line ADAs, on a one-month rotation schedule, which includes weekends, nights and holidays.

     

    Other Duties and Responsibilities related to the position of Counsel for the Investigations Division

    Qualifications:

    A Juris Doctorate required

    10 Years of criminal prosecution experience

     

    Experience Conducting Investigations

     

    Felony Trial Experience

    Appellate Experience

    Ability to effectively communicate orally and in writing

     

    Demonstrated experience in Strategic Planning (ie. staffing expansions/contractions).

     

    Must be able to effectively work under pressure and implement contingency plans

     

    Excellent reporting, presentation, and organizational skills.
