    Job Summary

    The Office of Equal Opportunity and Title IX ( OEO ) is responsible for overseeing the University’s compliance with University Policy and various state and federal regulations related to discrimination and sexual misconduct. The OEO is a resource for students, staff, faculty and other University community members who wish to report and address issues of discrimination and/or sexual misconduct.

     

    Develops and implements policies, programs, and operations for the OEO in relation to the OEO /’s responsibilities under the University of Utah’s Non-Discrimination policies under the supervision and direction of the Director. This includes responsibility for overseeing and conducting investigations of discrimination and sexual misconduct consistent with university policy, state, and federal law and managing all aspects of the University’s complaint resolution process.

    Responsibilities

    Applicants must demonstrate the potential ability to perform the essential functions of the job as outlined in the position description and description of job responsibilities. Essential Functions:

     

    1. Implements and administers new and existing programs and services for the Office of Equal Opportunity & Title IX ( OEO ) to internal and external participants under the supervision of the Director. Evaluates program effectiveness. May carry out and implement logistical plans and procedures to ensure that internal university and external entities’ needs are met.

    2. Assumes authority and performs functions of the OEO director in his/her absence.

    3. Participates in the development and interpretation of the university’s nondiscrimination and related polices to ensure compliance with University policy, state, and federal law.

    4. Establishes internal objectives and implements procedures to meet goals of the OEO . Assists in setting department short and long-term goals.

    5. Oversees and manages department staff including recruitment, performance evaluations and retention of staff. Directly manages staff potentially including Equal Opportunity Consultants, the employees who conduct investigations, the Hearing Coordinator and potentially other staff.

    6. Responsible for managing all aspects of the University’s discrimination complaint resolution process. Responsible for overall discrimination case management ensuring the prompt, thorough and impartial review, investigation, and/or resolution of discrimination and sexual misconduct cases, cases involving external agencies, and potentially requests for ADA accommodations and other functions.

    7. Oversees investigations of discrimination and sexual misconduct to ensure compliance with university policy and state and federal law. Coordinates with university administrators and communicates with parties throughout the complaint resolution process.

    8. Conducts investigations, including interview of individuals who have experienced discrimination and/or sexual misconduct and responding parties and witnesses; Identifies, gathers and reviews documentary or other evidence; analyzes all evidence gathered during investigation for the purposes of determining or recommending whether violations of university policy have occurred.

    9. Facilitates or oversees resolution of complaints through mediation, negotiation, etc.

    10. Manages procedures, including support and resources for all participants, during appeals or other University hearing processes.

    11. Prepares University response to state or federal government inquiries or complaints. Attends administrative hearings and mediation conferences with state and federal agencies. Manages and prepares OEO files for discovery and trial preparations and responds and coordinates with external agencies.

    12. Delivers training regarding sexual misconduct, discrimination, ADA / Section 504, and other equal opportunity statutes and regulations, in compliance with state and federal laws.

    13. Facilitates cooperative and collaborative relationships with the community and other institutions. Serves as a resource to University administrators, patients, guests, or participants, faculty, staff and students when equal opportunity issues arise.

    14. Ensures constituent satisfaction by responding to, and analyzing complaints, concerns and suggestions. Provides appropriate follow through to ensure quality service.

    15. Serves as part of the OEO management team.

    16. Other duties as assigned.

     

    Problem Solving. This position frequently addresses complex issues with a high degree of intersectionality with student conduct and human resource policies and issues. A major task for this position is to respond in a professional manner, be knowledgeable of university policies related to discrimination and sexual misconduct, hear and understand the needs of constituents and resolve issues. Comments. The incumbent must be proficient in making daily operational decisions in assigned area to ensure compliance of current regulations and guidelines.     Minimum Qualifications

    Bachelor’s degree in Business or Public Administration, a related area, or equivalency (one year of education can be substituted for two years of related work experience) required; plus six years of progressively more responsible management experience; and demonstrated leadership, human relations and effective communication skills also required. Master’s degree in Business Administration or related area preferred. This position is not responsible for providing patient care. Applicants must demonstrate the potential ability to perform the essential functions of the job as outlined in the position description.

     

    Preferences

     

    Juris Doctorate Degree. Two years of progressively more responsible management experience. Demonstrated leadership and effective communication skills preferred. Experience with legal issues in higher education, equal opportunity, employment law, discrimination law, Title IX, disability law, mediation, administrative employment processes, or related equivalent areas preferred. Experience in discrimination and sexual misconduct investigations preferred. A broad and substantive understanding of state and federal anti-discrimination law preferred. Knowledge of administrative processes preferred. Applicant should be proficient in legal analysis and writing. Applicant should demonstrate ability to work with students, staff, faculty in a respectful manner. Applicant should have excellent presentation skills and demonstrated effective communication skills.
