About the Legal Records Department
The Legal Records Department (LR) manages health information and legal information for the benefit of the patient and care providers of the Colorado Mental Health Hospital at Pueblo (CMHHIP). CMHHIP is a 458-bed psychiatric hospital with multi-specialty clinics serving the mentally ill and contracted agencies. LR manages active and closed legal records to provide a complete and accurate patient record and census reports for each patient. LR manages and monitors legal correspondence received, tracks hearings for staff and patients, and is the liaison between CMHHIP, Colorado Courts, and outside medical vendors. LR retrieves legal records for use by authorized requestors, protects the confidentiality of protected health information by complying with all applicable state and federal laws, rules, and regulations. Statistical databases are maintained for legal information, including Incompetent to Proceed, NGRI, Competency Evaluations, Mental Conditions, and Involuntary Medications. Liaison for legal information with the CEO’s Office and CMHHIP Administration. LR and LR staff participate in the hospital-wide Policy and Procedure Committee and the Centers for Medicare and Medicaid Utilization Review Committee. LR makes arrangements for all discharges for all forensic patients.

About the Position:
This position is responsible for the review and verification of court orders and Colorado Revised Statutes related to criminal proceedings. The position is responsible for admitting all patients in the Behavioral BEHR (BEHR) and completing all legal information in Legacy Cube. Functions as the primary liaison for CMHHIP staff, medical facilities, law enforcement agencies, attorneys, and courts for criminal proceeding issues. Duties include maintaining compliance with criminal statutes by ensuring the timely and accurate completion of paperwork. Provides direction and problem-solving regarding all forensic patients. Instructs physicians on the proper procedure for petitioning for court-ordered medications. Types the petitions for the attorneys to file for involuntary medication hearings. Provides training and guidance to staff regarding legal requirements for admissions and criminal paperwork. Independently determines and provides direction in resolving any issues about admission paperwork or legal issues arising during patient hospitalizations. Obtains any court waivers required for civil and criminal commitments. Notifies hospital staff, courts, and/or correctional facilities when additional paperwork is required for hospitalization. Independently calculates the maximum length of stay for incompetent patients to proceed. This position is responsible for coordinating arrangements for discharge for patients with the Colorado Sheriff’s Departments. Assists with annual regulatory 27-65 reviews. Job duties in this position include:
Admissions:
+ Reviews received court orders and decides which legal status classification and program are to be entered.
+ Checks appropriate databases to ensure patient has not been admitted to CMHHIP before.
+ Completes the entire admission in the BEHR including demographic information and insurance information.
+ Reviews court order to determine the correct legal status and what criminal charges are to be entered. For current inpatients, adds or closes additional legal status to all appropriate databases, and notifies hospital staff of additional legal status.
+ Obtains necessary documents for admission and subsequent changes of legal status from courts.
+ Provides direction to the Admissions Department, Administrative Assistants and other Clinical Staff regarding inconsistencies and informs them of the proper corrective action to ensure compliance regarding legal issues.
+ Determines accuracy of all legal criminal paperwork by monitoring all legal documents provided by Court Services and Admissions Department upon admission and throughout hospitalization.
+ Determines maximum length of stay for incompetent to proceed patients using Colorado Revised Statutes information, and enters information in appropriate databases.
+ Looks up all court cases in Colorado Court Data Access System.
+ Updates all legal information including admission dates, docket numbers, committing county, attorney, district attorney, judges, date of next hearing, due date of next evaluation and all other information from court order into appropriate databases.
+ Determines circumstances under which patient information can be released using HIPAA regulations.
+ Completes change of legal documents and distributes to appropriate staff.
+ Manages legal file to ensure all paperwork is current and accurate.
+ Scans all court orders and legal documents into the appropriate electronic record, Legacy Cube or BEHR.
Daily Discharges and Readmissions – CMHHIP and Outpatient Restoration Programs
+ Reviews the daily email that contains a report of evaluations mailed to the courts by the Court Services Department, and determines which patients need to be discharged and/or readmitted to a different program
+ Completes the discharge and/or readmission in both Legacy Cube and BEHR
+ Receives daily census via email, reviews discharges on the census report, and determines which patients need to be changed to a status waiting on the court’s decision for next steps (WAITCT or ORWAIT)
+ Admits patients to the appropriate program based upon their legal status and whether the competency evaluation is complete
+ If the patient discharges on involuntary medications, this position must communicate with Pueblo County Court regarding this status upon discharge
+ Receives emails from Administrative Staff at Arapahoe, Boulder, and Denver RISE Programs, Denver Health, and Peak View regarding census information, and which patients need to be admitted and/or discharged from each program
+ If the patient is discharged from RISE, Denver Health, or Peak View, determines what outpatient program the patient will need to be admitted to and admits the patient to that program
+ Upon receiving emails from Court Services and the Outpatient Restoration Program, discharges patients who have had their criminal cases closed by the committing court
+ Arranges discharges to the County Jails for patients recommended to be restored for CMHHIP, RISE Programs, Denver Health, and Peak View
+ Completes entry of discharge arrangements into Legacy Cube, and an auto-email is generated to the treatment teams
+ Upon admission to CMHHIP, RISE, Denver Health, or Peak View, sends restraining orders to the treatment teams as well as victim information
+ Emails restraining orders to the treatment units and RISE Programs upon admission of the patient or upon request of the Treatment Team
+ Scans all appropriate information/documents into the BEHR
+ Covers duties as needed for other positions for civil patients, including change of legal and scanning in orders
+ Prepares paperwork to be served on patients by the Public Safety Department
+ Sends back the return of service once the paperwork is served
Other Duties as Assigned
+ Maintains updated knowledge of standards: 27-65 Statute, CMS, JCAHO, and Health Department. Assists in onsite survey activities and/or provides assistance to the Director of Quality Management with completion of the Joint Commission's Focused Standards Assessment (FSA) which is submitted to TJC in non-survey years.
+ Assists with data entry for standards compliance as needed
+ Must make and take multiple calls from attorneys, the courts and other stakeholders as part of the daily routine. Responsibility to perform assigned tasks and duties within the scope of practice for this position that do not fall within the realm of duty statements A and B

Minimum Qualifications:
Experience Only:
Two (2) yearsof relevant experience in legal records and court orders
OR
Education and Experience:
A combination of related education, certification, and/or relevant experience in an occupation related to the work assigned, equal to two (2) years
Preferred Qualifications:
+ Experience in Legal Records Management preferred
+ Knowledge of Legal terminology
+ Experience in interpreting court orders
+ Experience entering information into electronic record systems
+ Experience with the Colorado Court System
