Position Summary
Accountable for higher level Senior Commercial Contract Manager duties for Owner Furnished Equipment for the Gas Program. This includes, but is not limited to: (1) Align behaviors to contractually binding obligations; (2) review and assess existing contract language; (3) review compliance to non-commercial contract terms; (4) review compliance to commercial terms; and (5) develop and monitor contractor performance. Enforce vendor compliance with contract terms and conditions such that all deliverables meet contract requirements. This individual will be the commercial single point of contact between the Business Unit and the Major Equipment (Gas Turbines, Steam Turbines, Transformers, etc.) Suppliers during contract execution and will be responsible for commercial contract governance and coordinating resolution for contractor commercial related change orders and disputes by engaging Risk Management, Legal, Supply Chain leadership and Senior BU leadership as required. This individual will be responsible for monitoring Owner's major equipment purchases for the Gas program, fostering the business relationship with key Suppliers, and working closely with the site contract managers. This position may be filled at the Senior CM level or Lead CM level, depending on experience.
Responsibilities
+ Lead and collaborate with Sourcing, Site Contract Managers, Project Managers, Construction Managers, Project Controls, Invoice Approvers, and suppliers/contractors to negotiate, influence, and manage commercial contract execution in a manner that aligns with approved strategies and meets overall Supply Chain and Customer requirements and objectives
+ Review and approve, reject, or modify change order requests for legitimacy against the existing contract in collaboration with Project Management. Manage the commercial aspects of ongoing work with Suppliers and review compliance with non-commercial terms. Sourcing of Purchase Orders, as required.
+ Lead the effort with Suppliers, Quality Assurance, Project Management, Project Controls to monitor Supplier equipment/material deliveries and engage Expediting as needed to support the overall project schedule
+ Ensure vendor compliance with commercial contract terms and conditions. Collaborate with Project Managers, Project Controls, Site Contract Managers, and Sourcing Specialists to resolve contract disputes, claims and defaults. Collaborate as required with Legal for necessary legal advice and support.
+ Maintain and enhance business relationships with counterparties and Suppliers to foster team building and accountability in the purchase and delivery of Equipment, Materials, and Construction Services
Required/Basic Qualifications (Sr Commercial Contract Manager)
+ Bachelor's degree in Finance, Accounting, Supply Chain Management, Engineering, Business
+ 5 years related work experience
+ In lieu of Bachelor's degree AND 5 years related work experience listed above, Associate's degree AND 7 years of related work experience OR High School/GED AND 9 years of related work experience
Required/Basic Qualifications (Lead Commercial Contract Manager)
+ Bachelor's degree in Accounting, Supply Chain Management, Engineering, Business, Science
+ 7 years related work experience
+ In lieu of Bachelor's degree AND 7 years related work experience listed above, Associate's degree AND 9 years of related work experience OR High School/GED AND 11 years of related work experience
Desired Qualifications
+ Bachelor's degree
+ Certified in Production and Inventory Management (CPIM) and/or Certified Purchasing Manager
Additional Preferred Qualifications
+ Strong working knowledge of Business Unit Partner Operations
+ Demonstrated knowledge of Commercial Contract Management.
+ Demonstrated knowledge of Sourcing and Commercial Risk areas
+ Project management or process improvement experience
+ Management experience
+ Demonstrated ability to collaborate with Project Management on major strategic projects
Working Conditions
+ Hybrid Mobility Classification – Work will be performed from both remote and onsite locations after the onboarding period. However, hybrid employees should live within a reasonable daily commute to a Duke Energy facility.
+ Normal office environment, typically at the job location for large construction projects, with occasional travel to other locations and industry meetings.
+ Site visits will be required to the Gas Program Construction sites.
Specific Requirements (Sr Commercial Contract Manager)
+ 5 years of demonstrated work experience (Project Management, Sourcing, Commerical Contract Management, etc.)
+ Demonstrated ability to negotiate and influence internal business partners, suppliers, and other stakeholders
+ Demonstrated effective oral and written communication skills
+ Demonstrated effective planning/organizational skills
+ Demonstrated effective problem solving/analytical skills
Specific Requirements (Lead Commercial Contract Manager)
+ Five of those years in practical major projects field experience.
+ Familiar with one of the following: CAS, MAXIMO, or similar purchasing software
+ Familiar with relevant power industry equipment usage (i.e.: turbines, generators, boilers, motor control centers, breakers, valves, etc. )
+ Knowledge of Project Management, Plant Maintenance, or Engineering concepts
+ Knowledge of business case development, total cost of ownership, and net present value concepts
+ Demonstrated ability to negotiate and influence internal business partner senior management, suppliers, and other stakeholders utilizing commercial acumen skills sets
+ Demonstrated problem solving and analytical skills
