    Duties Description Under the general direction of Counsel and the Board Deputy Counsel, the incumbent will provide legal advice to the Chairman, the Parole Board and other staff of the Department of Corrections and Community Supervision. 1. Represents the Board of Parole on 4-a Appeals filed by parole violators in court. •Drafts briefs and motions as well as obtains documents. •Drafts correspondence to opposing counsel, the court and the district attorney. •Settles the record on appeal. •Appears at court conferences and oral arguments before the court. •These may occur anywhere in the state, so the incumbent must be able to travel as needed. 2. Reviews proposed and pending legislation for legal sufficiency and effect on the Department of Corrections and Community Supervision. •Distributes copies of legislation to agency personnel and consults with them regarding effects of proposed legislation. •Researches laws, administrative rules and regulations to determine consistency with constructional provisions, existing statutes, case law, etc. •Prepares memoranda concerning effects of proposed legislation. •Prepares draft memoranda concerning agency's comments on legislation before the Governor for signature. •May prepare tentative drafts of legislation and amendments concerning agency program to be introduced in the Legislature.3. Reviews proposed changes in rules and regulations of the Board of Parole. •Analyzes proposed changes in light of existing laws and proposed legislation. •Prepares opinions concerning legality and feasibility of proposed changes. •Drafts rules and regulations to accommodate administrator's request or legislative mandate in format required for filing and publication. •Ensures compliance with SAPA requirements. 4. Participates as required in meetings with Board and DOCCS staff concerning the review and development and/or modification of Department policies, procedures and programs. 5. Provides legal advice to Board and DOCCS staff on a case- by-case basis. •Receives oral and written requests for legal opinion from staff. •Researches and interprets laws, rules, regulations, decisions, opinions and other legal sources to prepare response. •Consults with legal and program staff regarding present policies, rules and regulations. •Provides a written and/or oral response as to legal opinion of policies, rules and regulations. •Performs legal research and drafts memoranda of law concerning issues affecting the agency.6. Prepares legal documents such as contracts and assists with procurements for the Board. •Reviews documents for basic elements, legal sufficiency, clarity and conciseness of expression. •Obtains information from those concerned and assists in negotiations. •Prepares legal documents by contract, deed or lease using formats suitable for subject matter which expresses agreements of parties in clear, precise, unambiguous terms, and establishes conflict resolution mechanisms with the relationship as well as the specific grounds upon which a party may be held to be in breach. •Participates on ad hoc committees reviewing and recommending contract awards.7. Prepares digests of laws, rules and regulations of agency.8. Reviews and responds to administrative appeals filed with the Board of Parole.9. Reviews and responds to litigation filed against or concerning the Board of Parole. This includes, but is not limited to, analyzing the claims, records and decisions involved, preparing written analyses, and communicating with the Office of the NYS Attorney General.10. Drafts correspondence responding to inquiries relating to laws, rules and regulations of the agency.11. Responds to oral and written requests from the public for information relating to laws, rules and regulations of the agency. Responds to subpoenas. 12. Participates in training of new and existing staff.13. May handle ethics issues or be assigned as, or be a back up to, the Ethics Officer.14. May handle employment discrimination matters concerning the Board. 15. May supervise other attorneys. 16. Performs other related duties as assigned.

     

    Minimum Qualifications Must have been admitted to the New York State Bar and have four years of experience in the practice of law subsequent to admission to the Bar.

     

    Additional Comments Position is located within the Board of Parole, location is dependent on Departmental needs and candidate responses. Telecommuting, travel, and work hours to be discussed at time of interview.
