    About the Responsibilities

    As a Right of Way Specialist II, you would manage CAP's land rights and to guide CAP in identifying solutions to technical right of way problems that require the use of independent judgment and initiative in making difficult decisions that could have considerable impact on CAP's ability to manage and maintain CAP lands as intended. This position provides professional level expertise in the management, acquisition and sale of real property rights, as well as, ensuring the efficient and effective organization, storage, protection, and retrieval of technical engineering information and/or Lands record documents.

    Some of the duties include:

    1. Provides property management services and manages all aspects of CAP's land use applications and land use authorization program. Serves as a point of contact for private property owners, developers, utility companies and federal, state and local governments that request permission to install or construct private or public facilities/utilities on or across CAP controlled properties. Represents CAP at meetings and seminars to present details of our Land Use Program. Supports activities for GIS development and maintenance; contracts for appraisals and title company services and directs the focus of such services; plans strategy and negotiates land purchases and easements for project purposes; coordinates CAP land sales; performs as a liaison with Bureau of Reclamation (BOR) on CAP land issues; and serves on CAP committees as directed.

    2. Receives, reviews and processes Land Use Applications, assuring all authorization requirements have been fulfilled and application deposits have been received. Interacts with public officials, attorneys, engineers, planners and other professionals regarding land management issues. Reviews and or writes legal descriptions. Prepares and issues all land use authorizations.

    3. Responsible for the successful coordination and execution of authorized Lands Case projects through all phases of the lifecycle. Coordinates with Protective Services, CAP Inspectors and Project Engineers to ensure successful design, execution, commissioning, and turnover of Lands Cases. Assures all terms and conditions of the authorization are being met. Works with Licensee on resolution of disputes and other land related issues. Conducts fee determinations based on appraisals or BOR approved fee schedule. Upon completion of the project and acceptance of as-built plans, the Right of Way Specialist II prepares a Land Use License, Communication Land Use License, Construction Period Land Use License, Easement, Special Use Permit, Acceptance Letter, Consent Authorization, Notice to Proceed, Warranty Deed, Maintenance and Transfer Agreement, or other required authorization document and has it executed by all parties. Coordinates with Finance Department to invoice the Licensee when land use or administrative fee payments are due and assists with the collection of past due payments.

    4. Identifies and/or confirms unauthorized encroachments on CAP controlled lands.

    + Receives information from Protective Services, Maintenance or other outside sources regarding possible encroachment issues and verifies CAP land ownership OR locates encroachments during field visits or aerial photograph reviews.

    + Contacts the encroaching party by personal contact or written notice and attempts to resolve the issue by either negotiating a license or possible sale of the property. Works directly with CAP's Legal Department to resolve the encroachment as needed.

    + Conducts follow-up inspections and refers non-compliance issues to Protective Services.

     

    About the Qualifications

     

    + Bachelor's Degree with 3 years of years’ experience in large-volume and complex rights-of-way programs that include but are not limited to: land sales and purchases, recreation land use facilitation, trespass/ land encumbrance analysis and resolution, land research; OR, a High School Diploma or equivalent with 7 years’ related experience.

     

    Certifications or Licenses: Must have a valid driver’s license and maintain a good driving record.

    Preferred Qualifications:

    + Bachelor’s degree

    + Ability to read and interpret legal descriptions and/or right of way/construction plans.

    + Membership in the International Right of Way Association or other professional organizations is a plus.

    + Proficiency in the use of office computer programs, including databases, GIS, and document management systems is preferred

    + Some CAP experience is desirable.

    + Desirable training, licensure, and professional association membership could include State of Arizona 90- hour real estate law licensee training, Arizona real estate license, International Right of Way Association training/designations, American Society of Rural Appraisers and Farm Managers appraisal training/Arizona Licensing, American Petroleum Landman's Association, American Planning Association training/AICP certification, and surveying training/Arizona license.
