    Position Objective:

    Under the supervision of the Unit Chief, Senior Associate Counsel and MTA Bridges and Tunnels (“TBTA”) General Counsel, with latitude and independent judgement assists in matters related to protecting TBTA’s revenue stream including providing support for All Electronic Tolling/Open Road Tolling/E-Z Pass collection efforts as well as the overall functioning of the General Law I Toll Group and the TBTA’s General Counsel’s Office. This position is responsible for overseeing clerical/administrative staff. More specifically, this position processes subpoenas, acts as an interface with outside counsel and MTA counsel (obtaining documents, identifying witnesses, reviewing/preparing legal documents), and conducts legal research daily using Lexis/Nexis and other databases. In addition, this position creates and maintains various computerized databases and records and tracks information necessary to enhance the collection of toll revenue, as well as oversees the intake and processing of legal papers served on the TBTA, reviewing and processing invoices and requisitions, and assisting with the preparation of TBTA Board minutes.

    Responsibilities:

    + Selects, develops, and motivates personnel within the department.

    + Provides career development for subordinates.

    + Provides prompt and effective coaching and counseling.

    + Responsible for advising on the discipline/termination of employees when necessary.

    + Reviews the performance of staff. Creates a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.

    + Assists support staff and assumes their duties and responsibilities when they are absent.

    + Reviews and accepts service of legal papers for processing; prepares cases for assignment by the General Law I – Unit Chief or TBTA General Counsel, as appropriate to in-house or outside counsel; and assists New York City Transit, MTA Risk and Insurance Management, and other MTA Departments and subsidiaries in claims/litigation by contractors and third parties.

    + Assists relevant MTA Departments in handling property damage claims and Freedom of Information Law (FOIL) requests.

    + Develops, maintains, and manages various computer databases for reporting and tracking matters related to: matters assigned to in-house and outside counsel; records management, subpoena status, and outside counsel legal fees.

    + Trains attorneys and support staff on the use of TBTA/Toll Unit computer systems and databases.

    + With regard to All Electronic tolling/Open Road Tolling/E- ZPass and toll related projects and initiatives, provides assistance and support to toll collection counsel (in-house and outside counsel), TBTA Tolling Management, and the New York Customer Service Center.

    + Duties include, but are not limited to, assisting in the drafting of complaints by formulating and utilizing spreadsheets based on information obtained from Tolling Management and the New York Customer Service Center to calculate transactions and amounts owed by toll violators; utilizing legal research engines to identify and find defendants; creating and maintaining a database to track collection cases, records sent to outside counsel, case status and settlements; and tracking amounts collected and notifying Tolling Management to apply payments to the violators accounts.

    + Conducts legal research for general matters and litigation, including verifying quoted material, citations, and shepardizing .

    + Assisting in-house counsel in the preparation of legal documents (draft affidavits, discovery demands/responses, motions, exhibits, subpoenas, etc.)

    + As required, serve and file litigation documents in federal and state courts and administrative agencies using traditional and/or electronic CM/ECF (Case Management/electronic case filing) Filing methods.

    + Oversees and assists clerical/administrative staff in handling subpoenas, service of process, claims handling/processing, bankruptcy searches of toll violators, scheduling witnesses, obtaining documents, and obtaining video/surveillance footage.

    + Assists the TBTA General Counsel as necessary, including the preparation of staff summaries, MTA Board, and TBTA Committee minutes.

    + Other duties as assigned.

    + Demonstrated ability to communicate effectively with key internal and/or external stakeholders.

    + Must have strong managerial skills to effectively direct staff in implementing the Toll Group’s short- and long-term goals.

    + Demonstrated ability to complete short-term and long-term projects effectively and as efficiently as possible.

    + Demonstrated analytical capabilities and quantitative skills.

    + Demonstrated proficiency in Microsoft Office Suite or comparable applications, i.e., Word, Excel, PowerPoint, and Outlook.

    Required Education and Experience:

    + Bachelor of Science in Law and/or paralegal studies or an equivalent combination of education and experience from an accredited college may be considered in lieu of a degree.

    + Minimum of 6 years of experience as a paralegal, law clerk, or related experience in a law office or a legal department with a minimum of 4 years supervisory, management, or leadership experience.

    The F ollowing is/are preferred:

    + Intermediate to advanced skills in Excel, which may include pivot tables, conditional formatting, formulas, and/or If/Then statements.

    + Prior experience working in a large, multi-faceted, fast-paced organization or governmental body.

    + Familiarity with the MTA’s policies and procedures.

     

    Other Information

     

    May need to work outside of normal work hours (i.e., evenings and weekends)

     

    Travel may be required to other MTA locations or other external sites .
