Description of Job
This position of Agent in Charge (Criminal Investigator V) is located in the Division of Racing, Lakewood Office and will also be required to work as needed at the Division's Arapahoe Park and off-track facility located at 26000 E. Quincy Ave, Aurora, CO, 80016.
This position is primarily responsible for managing the development and execution of investigative activities, as well as overseeing enforcement systems to ensure they effectively meet the regulatory and enforcement objectives of the Division and the State. The role provides leadership and direction to a team of professional staff engaged in law enforcement, regulatory functions, and investigations. It is responsible for setting performance standards, establishing goals for both employees and program areas, and ensuring operational effectiveness. Additionally, this position plays a key role in developing staffing plans and operational procedures for the Enforcement and Investigations, Licensing, and Veterinary functions.
Regulatory Administration, Management and Oversight
+ Serves as manager for the Enforcement, Investigations, Licensing, and Veterinarian sections.
+ Ensures that forensic laboratory staff adhere to established procedures and policies for the receipt and storage of evidence, and that all laboratory operations comply with applicable state standards and regulations.
+ Monitors the Division's various enforcement systems, including ARCI, MLO, PSR and statistical reports, and veterinarian reports to ensure they effectively support the regulatory and enforcement objectives of the Division and State
+ Provides leadership to professional employees involved in law enforcement, regulation, and investigations as well as Colorado board certified veterinarians.
+ Sets performance standards and establishes goals for these employees and for the functions in which they are involved.
+ Develops staffing plans and operational procedure, and submits to the Director for approval.
+ Trains, directs, and supervises subordinate employees whose primary function is regulatory oversight of the racing community and stakeholders. This position will review applications that have been identified as problematic and will initiate appropriate disciplinary action for presentation to the Director of the Division of Racing Events and/or the Colorado Racing Commission.
Agency Liaison for Racing
+ Liaison to CSU veterinarian school for necropsy testing and veterinarian technician hires.
+ Obtains intelligence information, coordinating investigations, developing policies, and negotiating memorandum of understanding between other stakeholders.
+ Represents the Division with other stakeholder groups to include municipal and county governments and business establishments primarily only during the live season at the track.
Background Investigations & Criminal Investigations
+ Trains, directs, and supervises subordinate employees in the performance of their assigned duties, while also carrying out these responsibilities as part of daily operations.
+ Plans, coordinates and conducts complex investigations involving multi-jurisdictional and multi-national entities for purposes of exposing and evaluating areas of tax information, financial documentation, asset identification, analysis of the capital structure of a business entity to identify all parties who may have a claim to the company's assets, have detailed knowledge about securities reporting requirements Publicly Traded applicant must fulfill, as well as how the securities markets function in order to understand how capital can be, and is raised, source of investment funds, reputation, civil litigation, criminal history, accuracy of provided disclosures, and areas of fraud and misrepresentation.
+ Develops criminal investigative plans to address violations of applicable criminal laws for the unit and assigned personnel, and is responsible for the ongoing oversight and monitoring of these investigations.
+ Prepares written investigative reports and drafts affidavits for search and arrest warrants. Reviews and finalizes the criminal investigative documents prepared by other personnel. Executes warrants, collects and preserves physical and documentary evidence, and testifies in court. Prepares detailed reports and presents findings to the Division Director and Commission.
Investigation and Enforcement Strategy
+ Position regularly reviews Division policies and procedures regarding investigations, enforcement, and regulatory information to ensure source documents are robust, complete, and adequate.
+ In response to identifying a deficiency, this position will create, update, and/or modify these documents for approval by the Division Director. This may include material specific to professional standards, evidence, procedures, training, and compliance with State and Federal record-keeping requirements. During the off-season (Oct - May) this position will partner with the Arapahoe County Sheriff’s Office to improve critical incident responses and present findings and suggestions to the track and the Division Director.
+ Compiles data and completes an annual report to the Racing Commission to include injuries, number of race starts, test results for human and animal drug cases, investigative cases generated as well as other metrics of merit. This data is then used to make future policies decisions, new rules and/or suggestive legislative changes.
Supervision
+ Plan, prioritize, assign, analyze, and monitor workflow, and maintain appropriate staffing levels and review progress to ensure the quality and quantity of work meets standards and deadlines for deliverables to meet program goals and objectives.
+ Establish work schedules, review, and approve work time and absences.
+ Initiate the hiring process, provide subject matter expertise to HR during the comparative analysis process, interview candidate and hire with Director's approval.
+ Recommend promotions and changes in pay, submit personnel actions.
+ Resolve problems, performance issues, disputes, and informal grievances and initiate corrective action or recommend discipline as needed.
+ Identify training and developmental needs, and provide training as needed.
+ Provide feedback and coaching, write performance plans, and sign performance evaluations.

Special Qualifications:

+ Knowledge of Colorado rules and regulations related to Division of Racing.
+ Outstanding candidates will have extensive experience leading or managing complex criminal and regulatory investigations, including those involving multi-jurisdictional or multi-agency coordination.
+ Proven ability to develop and implement investigative strategies, policies, and procedures to support regulatory and enforcement goals.
+ Experience supervising multi-functional investigation teams, setting performance standards, and ensuring compliance with legal and ethical guidelines.
+ Familiarity with administrative hearings, regulatory compliance frameworks, and civil and criminal enforcement actions.
+ Demonstrated knowledge of relevant state laws and administrative regulations and enforcement procedures.
+ Proficiency in the Microsoft Office Suite and Google Workspace.
+ Experience preparing investigative reports, affidavits, and legal documentations for search and arrest warrants, and providing testimony in administrative and criminal proceedings.
+ Excellent communication and interpersonal skills, with the ability to present findings clearly to senior leadership, regulatory bodies, and law enforcement partners.
+ Experienced in evaluating enforcement systems and recommending improvements to enhance regulatory effectiveness.
+ Experience in financial investigations, forensic accounting, asset tracing, and analysis of complex financial structures.
Conditions of Employment with the CDOR:
