    Job Responsibilities:

    Erie 1 BOCES seeks a qualified candidate for the position of Labor Relations Specialist. The Labor Relations Specialist assists in contract negotiations for external school districts; advises external school districts on contract administration and employee disciplinary matters; participates in Civil Service Section 71, 73 and 75 hearings; conducts Education Law 3214 student hearings; conducts investigations of employee or student misconduct; and provides research and consultation on employee and student issues as directed by the Director/Manager of Labor Relations. Other duties as assigned. Must possess excellent oral and written communication skills, as well as have the ability to work effectively with diverse groups. Experience with personnel administration and/or NYS Education Law a plus.

     

    Negotiations/Labor Relations 1. Negotiates collective bargaining agreements with employee organizations representing certificated and/or classified civil service employees of participating school districts and the BOCES; includes contract analysis, development of proposals and counter proposals, serving as chief negotiator in formal and informal collective bargaining, and reducing agreed upon provisions to writing for incorporation into the collective bargaining agreement.

     

    2. Analyzes existing salary and fringe benefit data from districts in the geographic area, to aid in the development of negotiations proposals, evaluate proposed compensation and benefits, or prepare information for fact finding.

    3. Represents management positions of participating school districts and the BOCES in mediation and fact-finding, and improper labor practice or other proceedings before the Public Employment Relations Board (PERB).

    4. Provides assistance to participating districts and the BOCES in the administration and interpretation of existing collective bargaining agreements, including recommending positions, responding to grievances and drafting/revising memoranda of agreement.

    5. Researches and provides consultation to participating districts and the BOCES on various personnel matters such as layoff and recall, employee discipline, etc.

    6. Represents management positions of participating school districts and the BOCES in grievance and arbitration proceedings, disciplinary proceedings under a collective bargaining agreement or Civil Service Law §75, or termination hearings pursuant to Civil Service Law §§71 and 73.

    7. Stays abreast of current legislation, arbitration decisions, court or administrative agency rulings, and collective bargaining agreements to assess trends in school labor relations matters. Supervision- Supervises all Labor Relations staff Student Relations/Pupil Personnel-Researches and provides consultation to participating school districts and the BOCES on various pupil personnel matters such as student residency, confidentiality of student information and records, student discipline, etc. Serves as impartial hearing officer for participating school districts in Education Law §3214 student disciplinary hearings. School Attorney- May serve as back-up to the School Attorney to provide legal counsel and representation to the board of cooperative educational services as determined by the board; provide advice and counsel to the District Superintendent and administrative staff on legal matters.

     

    Student Relations/Pupil Personnel 1. Researches and provides consultation to participating districts on various pupil personnel matters such as student residency, confidentiality of student information and records, student discipline, etc.

     

    2. Serves as impartial hearing officer in Education Law §3214 student disciplinary hearings.

    Investigations

    1. Serves as an impartial investigator for participating districts of alleged or suspected employee/student misconduct or alleged civil rights violations.

    Communication/Committees

    1. Assists in preparation and delivery of workshops and seminars for administrative and other staff of participating districts regarding negotiations/labor relations and pupil personnel issues.

    2. Assists in preparation and delivery of workshops and seminars on negotiations/labor relations and pupil personnel issues for community, professional or other groups.

    3. Assists in reporting to participating districts on progress of negotiations and recent settlements in the area, court decisions, PERB rulings, legislative actions (Labor Relations Service Advisory Committee, newsletter or other periodic communications).

    4. Maintains professional affiliations and participates as active member in related organizations such as New York State Association of Management Advocates for School Labor Affairs (MASLA).

    5. Assists with maintenance of a reference library including negotiated contracts and current information regarding labor relations, personnel and student personnel issues, education, and related laws. Other duties as assigned by the Director, Labor Relations.

    Job Qualifications

    Minimum Civil Service Qualifications: Must meet minimum qualifications for provisional appointment as follows:

    A) Graduation from a regionally credited or New York State registered college or University with a Master's Degree in Employment or Labor Law, and two years of experience in labor relations involving employee negotiations or closely related field

     

    B) Graduation from a regionally accredited or New York State registered college or University with a Bachelor's Degree in labor relations or in a related field, and four years of experience involving personnel administration and labor relations

     

    C) An equivalent combination of the above

    Additional Qualifications:

    + Admission to New York State Bar in good standing AND up to two (2) years of experience in school district or other public sector collective bargaining negotiations, mediation, grievance administration and arbitration, OR;

    + Advanced degree in Labor Relations, Public Administration or a closely related field AND up to three (3) years of experience as described above; OR;

    + New York State certification as a School District Administrator or equivalent AND up to three (3) years of experience in school administration which involved direct and active participation in collective bargaining negotiations, contract and grievance administration AND Knowledge of public sector personnel administration and public employment labor relations in New York State Knowledge of applicable federal and New York State laws and regulations pertaining to various pupil personnel issues

    + Demonstrated ability to work effectively with boards of education, educational administrators, district staff (or similar constituencies) and representatives of labor organizations

    + Experience in conducting seminars and/or in-service training on various labor relations issues

    + Excellent communication skills, both written and oral Excellent research skills, organizational skills and initiative

    + Valid driver's license and reliable transportation

    + Some evening hours required (varies)
