S ummary
The Assistant Director, Construction Diversity Programs and Contract Compliance Management, MTA Construction & Development , will efficiently administer the Diversity Compliance Program for the MTA Capital Program. Charged with providing continuous oversight and support of all aspects of Federal Disadvantaged Business Enterprise (DBE) requirements, New York State Minority and Women Business Enterprise (M/WBE), Service-Disabled Veteran - Owned Businesses (SDVOB) Contract and Procurement policy, standards , and procedures. The person in this role will provide support for MTA ' s $ 54 billion, 2020-24 Capital Program Plan, the largest in New York history, by working closely with t he MTAC&D Director, Construction Diversity Programs and Contracts Compliance Management, MTAC&D Contracts, MTAC&D Delivery Project CEO's and Project Managers, Owner Agencies, and the MTA Department of Diversity and Civil Rights (DDCR) with the development and implementation of the contractor/consultant construction and supplier diversity strategic plan, initiatives and compliance reporting within MTAC&D.
The Diversity Compliance Team will be responsible for the overall compliance and diversity inclusion for MTA C&D ' s current portfolio of contracts , which consists of all Capital Projects from Bridges and Tunnels (TBTA), Long Island Rail Road, Metro-North Railroad, New York City Transit , and the former legacy Capital Construction Mega Expansion Projects. O ver 700 existing and consolidated contracts and over 500 Projects (East Side Access, LIRR 3rd Track, Penn Station Access, Penn Station Train Hall Renovation, Second Avenue Subway s tations).
Responsibilities
Assess, monitor, and implement construction and procurement supplier diversity and compliance directives for the MTA Capital Program to ensure utilization of Disadvantaged and Small business enterprises (DBE), Minority-Owned and Women-Owned Businesses (MWBE), and Service-Disabled Veteran - Owned Businesses (SDVOB) for approximately 700 contracts and 500 projects in MTA's $54 billion 2020-24 Capital Plan.
Centralize and coordinate reporting requirements for p rocurement, including Quarterly Reports, Year-End Reports to MTA, and ad hoc reports as requested and required by MTA Audit, MTA IG's Office, MTA Board, CPOC, MTA Finance/Grant Management, Federal Transit Administration, and the Federal Railroad Administration in all matters relevant to Diversity Compliance.
Evaluate and expedite high-volume complex bids and quotations for responsiveness and compliance with the 30% MWBE , BE 22%, and SDVOB 6% goal requirements following the MTA All-Agency Procurement and All-Agency Responsibility Guidelines of Construction, Consulting, and Design - Build contracts.
Coordinates the Policy and Procedures process for Diversity Compliance, including updating or creating new Internal Controls as required. Assure Diversity Compliance policies and procedures are current and reflective of State and Federal regulatory requirements , and perform research, benchmarking/best practice reviews as needed. Conduct research of peer and other transit agencies for best practices to be incorporated into Internal Procedures and Guidance documents.
Review procurement - related edits to scopes of work, technical specifications, project requirements & schedules in consultation with Owner Agencies to ensure the assembly of appropriate terms & conditions in contract documents.
Communicate with vendor/contractors on high - level matters regarding Diversity Compliance, including procurement procedures related to supplier diversity reporting, monitoring, and MWDBE/SDVOB goal waiver resolution where required. M ediate prime and sub-contractor disputes, including payment issues, goal waiver requests, retainage, and close-out contract compliance issues.
Assists with directing and driving MTA C&D Procurement's discretionary spending goals up to $1 Million. Track discretionary bid results and other pertinent information required to analyze Good Faith Effort to outreach and engage with MWDBE and SDVOB vendors. Recommend, enforce, and implement policies and methodologies based on industry knowledge and best practices.
In consultation with Project Management, serve as a liaison to evaluate MTAC&D and Contractor requests for extra work change orders and supplemental agreements, and assess the validity of additional work proposals to ensure Diversity Compliance guidelines are being met.
Participates in Industry Forums and Outreach, Pre-Bid/Pre-Construction Meetings, Contractor Selection Panels, Vendor Progress meetings, and , as required, with Owner Agency departments to foster a culture of inclusion and ensure continued success of M/WBE/SDVOB and Small Businesses in MTAC&D Contracts and Procurements.
Education and Experience
Bachelor ' s degree in Public Administration, Finance, Business Administration , or related field.
Minimum of seven (7) years of experience in a similar position within a minority, women, or small business enterprise program and business initiatives, contract, or public administration related to the solicitation, administration of procurements, construction , compliance reporting, or comparable environment.
Familiarity with MTA All-Agency Procurement G uidelines and Principles and government contract regulations.
Knowledge of MTA objectives and operations; an extensive understanding of Diversity Compliance, MWBE, SDVOB, Small Business Enterprise, State and Federal (FTA or FRA) regulations.
Knowledge of products and materials, terms and conditions, contract law, and public sector purchasing.
Possess excellent time management skills to prioritize, plan , and track multiple projects, organize, and multitask in a flexible, fast-paced, and challenging environment.
Communicates and influences effectively, with the ability to motivate and influence internal and external stakeholders.
Ability to remove barriers, manage change, resolve conflict, build consensus , and motivate stakeholders.
Excellent organizational skills, effective written and verbal communication skills, and ability to work effectively with all levels of management, internal and external agencies , and stakeholders.
Ability to partner with senior leadership to craft and execute visionary solutions.
Ability to build and maintain effective working relationships.
Ability to work with minimal supervision.
Must be a self-starter with a strong work ethic.
Knowledge of Microsoft Office Suite and comparable applications.
