    Duties Description The incumbent of this position will be assigned to serve as the Director of the Bureau of Litigation within the Department of Health’s Division of Legal Affairs. The incumbent will report directly to the Deputy General Counsel and will be responsible for the management, oversight and coordination of all of the Bureau of Litigation’s legal staff and activities.Responsibilities include:Managing the Bureau of Litigation, reviewing legal papers served or received to determine appropriate responsive action; advising DOH program staff of litigation commenced and developments in existing litigation and determine agency position on issues raised by legal papers; conveying agency position and legal precedents to the Attorney General’s office and develop with the Attorney General the agency’s legal position; preparing indicated affirmations, briefs, and other papers for use in litigation; reviewing requests for legal action received from DOH program staff to determine appropriateness, preparing referral letters to the Attorney General, and providing aid to the Attorney General in developing the agency’s case; preparing memoranda to DOH program staff advising them of developments in litigation, legal obligations, and the ramifications of court orders and decisions; overseeing responses to subpoenas and other requests for information; and maintaining docket books, index books and filing system. The incumbent will supervise and mentor Bureau attorneys and support staff; meet with and keep the Governor’s Office apprised of significant litigation matters, help ensure that standards are adopted as regulations to minimize litigation risk; and develop effective coordination with Attorney General’s affirmative litigation group; identify strategies to maximize the benefit of this group’s work to DOH; and assess opportunities for affirmative litigation by DOH.

     

    Minimum Qualifications Candidates must be admitted to the New York State Bar and have six years of experience in the practice of law subsequent to admission to the Bar.The preferred candidate must have strong legal writing, oral communication, and analytical skills. The candidate must be able to work as a member of a team, possess good decision-making skills, and must have the ability to handle high-volume activities in a deadline-driven environment. The ability to organize and prioritize a high volume of tasks is critical. The preferred candidate should be a highly motivated individual who is interested in working in an active legal team environment on matters involving a wide variety of public health issues.
