Job Description
The Iowa Department of Health and Human Services (HHS), Division of Compliance, Bureau of Data Privacy and Strategy is seeking a Compliance Officer to join our team!
Under the direction of the Chief Data Officer, provides oversight and coordination to program staff for all data sharing agreement governance, development, execution, management, and monitoring of data sharing matters to ensure compliance with federal and state laws and department policies.
+ Meets with, collaborates, and directs the process with functionally-assigned Iowa HHS program staff and leadership to ensure department policies are followed.
+ Advises Iowa HHS program staff of processes, procedures, and necessary steps required to draft, route, issue, execute, and monitor compliance with Iowa HHS practice and processes and state and federal laws.
+ Recommends approval or denial of all data sharing agreements and amendments prior to the issuance for data user signature and execution by Iowa HHS authorized signatories.
+ Conducts negotiations with data sharing agreement users and their organizations as necessary.
Directs the process for research agreements with functionally-assigned Iowa HHS program staff, Research and Ethics Review Committee members, and leadership to ensure department policies, and state and federal law are followed.
+ Approves all research agreements and amendments prior to the issuance for data user signature and execution by Iowa HHS authorized signatories.
+ Ensures compliance with Office of Research Integrity policies and procedures for internally completed or contracted research.
+ Presents research proposals to the Research and Ethics Review Committee, serving as a liaison between the researcher and the Agency.
Provides oversight and coordination to program staff, leadership, and Service Contracts Bureau staff on data sharing terms within contracts and Memoranda of Understanding.
+ Analyzes data use and sharing within contracts compared to General Conditions contract language and proposes special conditions terms to ensure compliance with state and federal privacy and confidentiality laws and department policies.
+ Reviews and approves contracts with data use and sharing terms prior to final approval by Service Contracting and Grant Management Staff.
+ Ensures all data-related terms and conditions of funders are followed.
Coordinates with Iowa HHS Security Officers to ensure all contracts and agreements comply with security requirements for various state and federal privacy laws.
Develops and delivers trainings and presentations on data sharing policies and procedures to train Iowa HHS staff on appropriate procedures. Assists with the development of policy to implement data governance initiatives for Iowa HHS.
Provide assistance with the open records request workflow, including review of requests for records as they are received, communication with the requester to refine requests as necessary, providing direction and oversight to HHS team members in the production of records responsive to the request, approval for the release of all responsive documentation, and coordination with legal counsel when legal review is determined necessary.
+ Reviews records produced in response to a records request prior to release.
+ Ensures adherence with the Department's confidentiality laws and regulations and compliance with Iowa Code chapter 22 in the review and release of records.
+ Drafts communications to requesters specifying the reasons for withholding confidential records.
+ Coordinates releases of information from requesters when appropriate to address confidentiality concerns.
+ Assists with responding to Open Records requests that involve confidentiality or privacy concerns.
This position is currently funded through December of 2027.

Minimum Qualification Requirements
Applicants must meet at least one of the following minimum requirements to qualify for positions in this job classification:
1) Graduation from an accredited four-year college or university with a degree in any field, and experience equal to five years of full-time work in investigative or closely related work which involved: preparing interpretative or administrative orders, rules, or regulations which have the effect of law; or interpreting and enforcing federal or state laws governing health care administration; or quality assurance review to determine, through internal audit or analysis, the level of compliance with program requirements; or drafting, negotiating, or examining contracts or related documents required for organizational operations.
2) Graduation from an accredited four-year college or university with a degree in any field, and experience equal to five years of full-time, professional-level work involving the interpretation and enforcement of federal and state laws or department policies and procedures or quality assurance review as determined through internal audit or analysis of the level of compliance to program requirements.
3) Graduation from accredited school of law and experience equal to two years of full-time work as described in number one or two or in the practice of law.
4) A total of nine years of education and/or full-time experience (as described in number one, two, or three), where thirty semester hours of accredited college or university coursework in any field equals one year of full-time experience.
5) Current, continuous experience in the state executive branch that includes experience equal to two years of full-time management/supervisory work in the interpretation and enforcement of federal and state laws or department policies and procedures or quality assurance review.
6) Current, continuous experience in the state executive branch that includes experience equal to eighteen months of full-time work as a Compliance Officer 1.
