Duties Description Reporting to the General Counsel, the Associate Counsel (Appeals Counsel) will serve within the Office of General Counsel at the Office of Cannabis Management (the Office or OCM) and will work on appeals to the Cannabis Control Board (the Board) from administrative decisions and licensing location denials, and other matters that may require written opinions from the Board. The Appeals Counsel will develop procedures for managing appeals submissions and draft recommended decisions for the Board’s timely review and consideration of such appeals. The Appeals Counsel may also be requested to assist with litigation matters in State or Federal courts in which the Office and/or the Board are named as defendants.Duties may include, but are not limited to:• Develop a process for interested parties to submit requests for exceptions from the Office’s determinations relating to distancing requirements for cannabis retail dispensary locations.• Review of requests for exceptions and prepare recommendations to the Board regarding such requests.• Review appeals from administrative hearing determinations and prepare recommendations to the Board regarding the Board’s determination of such appeals.• Supervise one or more attorneys assigned to assist with reviewing or drafting recommendations to the Board related to requests for exceptions or appeals from administrative hearings decisions.• Research and prepare legal memoranda as requested by the General Counsel or the Board.• Assist with litigation in which the Office and/or the Board are named as defendants, including, as follows: provide legal counsel, advice and strategies in presenting evidence and testimony; prepare and/or review legal briefs; and draft affidavits and other submissions for state and federal court matters.• Other duties as assigned by the General Counsel.
Minimum Qualifications Candidates must have been admitted to the New York State Bar and must have had four years of experience in the practice of law subsequent to admission to the Bar.Preferred Qualifications:The ideal candidate will have prior experience with one or more of the following: • Administrative hearings and appeals. • Licensing regulations and compliance. • General litigation relating to agency regulatory practice, and/or appeals. • The candidate should be able to work independently and exercise discretion when advising the members of the Cannabis Control Board, a public body charged with overseeing the implementation of the of an equitable, safe, and legal cannabis industry in New York State.NOTE: IN ORDER TO AWARD THE PROPER CREDIT FOR WORK EXPERIENCE, RESUMES MUST INCLUDE MONTH AND YEAR FOR START AND END DATES. IF ANY OF THIS EXPERIENCE IS LESS THAN FULL TIME YOU MUST INDICATE THE AVERAGE NUMBER OF HOURS WORKED PER WEEK.
Additional Comments NOTE:• Travel may be required (approximately 5%), including during evening and weekends, depending on mission and assignment. • Possession and maintenance of a valid Driver’s License issued by the NYS Department of Motor Vehicle is required, or otherwise demonstrate the capacity to meet the transportation needs of the job.
