    Duties Description The Associate Counsel will act as the Chief of the Bureau of Energy and Federal Affairs in the DEC Office of General Counsel. As Bureau Chief, the Associate Counsel will directly supervise approximately 6 attorneys providing support to the various programs working on Energy projects, and who interact with the Federal Government. This position is necessary to provide management to Bureau staff, and to support the Department in the implementation of the above noted programs, many of which are of high priority and time sensitive. The attorneys in this bureau work on a variety of matters, such as permit proceedings, litigation, negotiations, rule-makings, drafting of legal documents and responding to requests for legal advice. Given the number of staff in the Bureau and the nature of the work, it is necessary for an experienced counsel to be in this position now in order to support the Department’s mission, and ensure timely legal advice and support for the affected programs. The description of the duties for this position and percentage of time for each duty follows.-65% Monthly: The Associate Counsel will serve as the supervisor and manager of the 6 lawyers in the Bureau. •Assign work to Bureau staff, and manage staff to ensure timely completion of assigned duties;•Review and edit work from Bureau members to make sure the work product is of acceptable quality and forward approved work to the Deputy Counsel, Director, and General Counsel.•Develop form documents for the Bureau.•Establish, use and maintain technology to maximize the efficiency and effectiveness of all legal staff to conserve and responsibly use Departmental resources.•Perform supervisory functions for the Bureau, including training, drafting work plans and evaluations for Bureau members, approving vacations and other leave, and other supervisory duties;•Provide direct supervision of staff in-training to be legal professionals.•Meet Professional Expectations and Maintain the Quality of the Workplace: through action and example, be a positive role model to staff in your program, other DEC staff, the public, and private and governmental agencies. Actively manage workload and available time to complete assignments and fulfill responsibilities as an effective member of the DEC team. Arrive at work prepared and be professional, courteous, respectful, responsible, and as necessary patient when interacting with staff, the public and other stakeholders. Foster a positive attitude to promote and encourage a good morale among staff, both within the office and while representing the Department outside the office. Ensure you and your staff adhere to Public Officer, Ethic and Conflict of Interest laws and guidance. Stay current with LATs and ensure all entries are accurate for both yourself and anyone you supervise. Ensure that you and staff you supervise are familiar with opportunities and resources available through EAP. Find and propose professional development and skills training for yourself and your staff as resources permit. Strive to generate unsolicited compliments for program and personal responsiveness, attitude, excellence and productivity. •Perform other supervisory duties as needed.-20% Monthly: The Associate Counsel will serve as counsel to the General Counsel, Director, Deputy Counsel, Executive Staff members, Division Directors, Regional Directors and Regional Attorneys.•Provide timely advice, guidance, and responses to inquiries from Executive Staff, the Deputy Counsel, the Director, and the General Counsel, including interpretation of law and legal procedure;•Effectively communicate verbally and in writing with Department staff and all outside parties.•Interact with staff from the United States Environmental Protection Agency (EPA) with respect to the Department’s implementation of energy projects, and regarding legislation and rule-makings conducted by the Federal government.•Responsible for advising the Commissioner and Governor’s staff as to the Department’s implementation of the Bureau’s programs; and•Regularly meet with management staff from the affected divisions, to ensure program needs are being met.•Maintain the strictest standards of confidentiality regarding all verbal and written communication and records in the Department, and regarding the management of staff, and meet professional standards and expectations.•Implement and Advance the Commissioner’s and DEC’s Mission and Priorities. Maximize the use of all available legal mechanisms to reinforce the Commissioner’s priorities for full, thorough and fair application of environmental laws to meet agency priorities and to achieve the Department’s mission to conserve and protect the environment of New York.•Perform other duties and accept other responsibilities, as assigned or directed by the Deputy Counsel, Director, and/or General Counsel.-15% Monthly: The Associate Counsel will serve as litigation counsel.•Negotiate and prepare various legal documents, discuss strategy and confer with Department staff regarding legal options in permitting cases.•Supervise Department staff members assigned to litigation matters in the Bureau’s programs, including providing support during any administrative hearing matters;•Must have strong interpersonal skills to ensure there is a good working relationship internally and with other partners and stakeholders, including the Office of the Attorney General;•The individual must be able to assist with the drafting and review of necessary documents related to any civil litigation; and•The attorney must ensure that the Department’s perspective, policies and goals are considered in developing litigation strategy.

     

    Minimum Qualifications NYS Bar Admission and 5 years of post-bar experience.

     

    Additional Comments Travel may be required.Overtime may be required.
