Job Information
Doosan Bobcat North America, Inc. (“Bobcat”) is seeking a highly skilled and experienced Intellectual Property (IP) Litigation Attorney to join our dynamic legal team. The ideal candidate will possess a comprehensive understanding of intellectual property law, with a strong emphasis on litigation (patent, trademark, copyright, and trade secret disputes). In addition, experience in IP transactional matters (licensing, M&A due diligence, IP agreements), especially matters involving monetization of IP assets, is preferred. This role will be critical in protecting and leveraging Bobcat's valuable IP assets, mitigating risks, and supporting our innovative business initiatives.
Role & Responsibility
IP Enforcement, Litigation, & Dispute Resolution:
+ Manage and oversee offensive and defensive IP litigation matters (patent, trademark, copyright, trade secret infringement, unfair competition), working closely with external counsel, VP of Legal, Deputy General Counsel, and other litigation and IP attorneys at the company.
+ Develop global litigation strategies, manage discovery, and prepare for hearings, mediations, and trials.
+ Conduct legal research and analysis related to IP disputes.
+ Provide pre-litigation advice and risk assessment to business units and executives.
+ Handle cease and desist letters and other pre-suit communications and negotiations.
+ Work with the company’s in-house IP attorneys, engineers, and other personnel to identify potential infringements of the company’s IP assets and develop and implement enforcement and/or monetization strategies.
Advisory:
+ Provide strategic legal advice to internal stakeholders (R&D, product, marketing, sales, executive leadership) on all aspects of IP law.
+ Monitor legal developments in IP law and advise on potential impacts to the business.
+ Advise the company on potential IP risks in its products and services.
IP Transactions:
+ Draft, review, and negotiate a wide range of IP-related agreements, including licensing agreements (inbound and outbound), joint development agreements, strategic alliances, research agreements, and confidentiality agreements.
+ Conduct IP due diligence for mergers, acquisitions, divestitures, and other corporate transactions, identifying risks and opportunities.
+ Identify and assess IP risks and develop mitigation strategies.
+ Identify and assess IP monetization opportunities and develop licensing strategies.
General Legal Support:
+ Collaborate with other members of the legal team on various legal matters as needed.
+ Assist in managing relationships with outside counsel and controlling legal spend.
Job Requirement
Qualifications
+ Juris Doctor (J.D.) degree from an accredited law school
+ Active bar membership in good standing in Georgia, Minnesota, or eligibility for admission via reciprocity
+ 8+ years of experience practicing intellectual property law, with a significant focus on both transactions and litigation, gained at a reputable law firm or in-house legal department
+ Strong understanding of patent, trademark, copyright, and trade secret law
+ Demonstrated experience managing IP litigation, including strategy development, discovery, and settlement negotiations
+ Experience in drafting and negotiating complex IP agreements
+ Excellent analytical, communication (written and verbal), and interpersonal skills
+ Ability to work independently and collaboratively in a fast-paced environment
+ Strong business acumen and ability to provide practical, business-oriented legal advice
Preferred Qualifications
+ Undergraduate degree in a technical field (e.g., mechanical engineering, electrical engineering, computer science, or other similar technical fields)
+ Experience in the construction equipment industry, heavy equipment, or automotive
+ Licensed to practice before the U.S. Patent and Trademark Office
