Summary: The Legal Counsel—Medical Malpractice Litigation position serves as in-house counsel focused on managing medical malpractice claims and complaints against the health system, its hospitals and its staff. Responsible for overseeing and managing outside counsel who are representing Parkview in malpractice actions and other general liability actions. Responsible for overseeing and managing Parkview’s self-insurance trust, working closely with Parkview’s outside broker on insurance-related matters and overseeing Parkview’s lines of malpractice and liability insurance coverage and other lines of coverage as assigned. Also responsible for oversight of assigned pre-litigation disputes, administrative proceedings and litigation associated with Parkview Health facilities, staff, and patients related to malpractice and other matters. Responsible for managing non-party litigation requests received by Parkview, such as subpoenas for documents or testimony. Along with other members of the legal team, works closely with all of the Hospitals’ Chief Medical Officers and provides legal support for hospital medical staff issues and peer review matters, as well as provides day-to-day legal guidance on operational and patient care-related matters. Provides legal assistance to and works collaboratively with the Risk Management Director to provide legal support to the Risk Management team. Also responsible for providing legal advice to Parkview’s Police Department regarding a wide range of police enforcement issues. Keeps abreast of all legal and regulatory changes, issues, and proposals that impact Parkview for any of the foregoing subjects and keeps leadership informed of the impact of any potential or approved changes. Provides legal assistance on other topics and in different areas of the health system as needed.
Education: Must have a Bachelor’s Degree and Law Degree from an accredited law school.
Licensure/Certification: Must be licensed to practice law in Indiana in good standing.
Experience: Must have a minimum of five (5) years of litigation experience, preferably in health care law and malpractice litigation. Additional years of legal practice experience is preferred for this position. Requires experience overseeing and managing outside counsel and the expenses associated with legal representation. Must have solid verbal and written communication skills. Must be able to work collaboratively with multi- disciplinary teams across the health system, including physicians, nurses and other providers. Requires broad knowledge of State and Federal laws including, hospital peer review laws, healthcare laws, malpractice and laws affecting Parkview’s Police Department. Must have ability to present complex information clearly and understandably to small and large groups, including senior leadership, Boards and Board Committees.
