    Duties Description Social Justice DivisionReal Estate Finance Bureau — New York City Assistant Attorney General, Enforcement Section Reference No. REF/ES_NYC_AAG_3798Salary Range: $83,594 - $178,463 + $4,000 in location payTo be considered for this opportunity, submit a complete application online at ag.ny.gov/job-postings/attorneysThe Office of the New York State Attorney General (OAG) is seeking a litigator to serve as an Assistant Attorney General in the Enforcement Section of the Real Estate Finance Bureau (REF). REF is charged with the enforcement of Article 23-A of the New York General Business Law (the “Martin Act”) and governing regulations that relate to the public offer of real estate securities, including cooperatives, condominiums, timeshares, homeowners associations, syndications, and senior living communities. REF also has jurisdiction over the conversion of rental buildings to condominiums and cooperatives as well as affordable housing developments that include the offer of cooperative interests in realty.REF’s Enforcement Section enforces the Martin Act and New York Executive Law and protects New York purchasers, homeowners, and tenants both through investigating complaints from the public and developing affirmative initiatives with other OAG bureaus and government agencies on issues such as the preservation of affordable housing and abuse of tax benefits. REF has recently investigated issues such as misuse of purchaser down payments, failure to disclose environmental hazards, misleading sales practices, and the violation of tenants’ rights in cooperative and condominium conversions. Duties:• Investigating complaints from the public related to Martin Act and New York Executive Law violations. • Identifying issues for affirmative litigation initiatives and developing such initiatives from the ground up. • Drafting subpoenas, motions, complaints, petitions, and settlement agreements. • Taking testimony of witnesses, litigating cases in various courts, and engaging in settlement negotiations.• Assisting with the development of REF’s policy, regulatory, and legislative initiatives.

     

    Minimum Qualifications Qualifications:• Applicants must have at least three (3) years of post-graduate litigation experience. • Excellent analytical, writing, research, and communication skills. • Highly organized and motivated with the ability to handle a diverse, fast-paced, and high-volume caseload consisting of document review, investigations, affirmative litigation, and settlement negotiations.• Strong preference will be given to applicants with a background in government litigation and/or complex commercial litigation. Applicants must reside in (or intend to soon become a resident of) New York state and be admitted to practice law in New York state. In addition, the Public Officers Law requires that OAG attorneys be citizens of the United States. A two (2) year commitment upon being hired is a condition of employment.
