    Job Description

    The System Offices is one of several system members within the Texas A&M University System representing one of the largest systems of higher education in the nation, with a network of 11 universities, a comprehensive health science center, eight state agencies, and the RELLIS Campus.     Job Description Summary:

    This position provides legal support to administrators, faculty and staff of The Texas A&M University System on behalf of the Property and Construction section.

     

    Responsibilities:- Advises A&M System Members and the A&M System Office of Facilities Planning and Construction on various construction related matters, including but not limited to review and approval of architectural/engineering and construction procurement documents, contracts and guarantee maximum price proposals. Additionally, provides review and assistance with contract claims, potential errors and omissions and construction design defect matters, reviews and approves construction agenda items for the Board of Regents, assists with potential claims against project performance and payment bonds, and works with the Office of the Attorney General on potential and active construction litigation matters.- Reviews and advises A&M System Member and the A&M System on wills, trusts, estates and other gift issues, including but not limited to handling of distribution of testamentary gifts, coordination with the System Treasury Office on the disbursement of gifts where a System member is a beneficiary of an IRA or other financial account, consultation on trust modifications and assistance with will contests, including coordinating assistance from the Office of the Attorney General. Additionally, assists with review of gift agreements, approval of monetary and non-monetary gifts for legal sufficiency, and review and approval for legal sufficiency of Board of Regents agenda items for the naming of buildings and other geographical areas on System Member campuses.- Prepares a variety of real estate and other transactional documents, including but not limited to, contracts for the sale and purchase of improved and unimproved real property; real property ground leases, office leases, telecommunications leases, agricultural leases, and residential leases; permits and licenses; easements; professional service agreements with surveyors, appraisers and environmental engineers; residency agreements; facility use agreements and gift agreements.

     

    - Reviews title commitments, title exceptions and surveys.

     

    - Identifies and resolves title defects.

     

    - Coordinates real estate closings.- Provides legal advice and counsel to System administrators, faculty and staff in various areas, including but not limited to: interpreting federal and state laws and regulations; interpreting System policies, regulations, and rules; developing and drafting policies and procedures; reviewing and analyzing legislative bills; drafting legislation; and developing well researched internal legal memorandums and opinions.- Participates in Office of General Counsel matters, including practice area assignments, workshops, briefing papers, legal memoranda, special initiatives, etc.

     

    - Provides representation of and legal advice and counsel to System clients in judicial and internal and external administrative hearings.- Other duties as assigned.

     

    Education and Experience:- B.A/B.S. plus an earned LLB or JD degree or equivalent combination of education and experience.- Three years of related experience.

     

    Registrations, Certifications, and Licenses:Member of the State Bar of Texas in good standing or will obtain a Texas law license through reciprocity within 12 months of hire date.

    Knowledge, Skills and Abilities:

    - Effective written and verbal communication skills and ability to manage a broad range of complex legal issues.

     

    - Availability to travel across state to System locations. - Ability to multi-task and work cooperatively with others.

    Preferred Qualifications:

    - Experience handling public construction-related projects and legal issues.- Experience representing and/or working with Texas state agencies.
