    Summary THIS IS A ND NATIONAL GUARD TITLE 5 EXCEPTED SERVICE POSITION. Military membership is NOT required. This ND National Guard position is for a ATTORNEY-ADVISER (GENERAL), Position Description Number T0097000 and is part of the ND JOINT STAFF, National Guard. Responsibilities The primary purpose of the position is to serve as the full-time professional legal adviser and support to the Adjutant General, the Commander of federally recognized Army and Air National Guards, and ND unique public defense or safety structures or wing commander . Acts as a legal adviser/attorney for the ND National Guard, responsible for assisting in the formulation of ND legal policy pertaining to prevention of sexual assault, sexual harassment, and domestic abuse, while serving as the special legal advisor to the Adjutant General, the Office of Staff Judge Advocate (OSJA), Commands SHARP and SEEM programs. Serves as the primary point of contact for outside entities and stakeholders, including Special Victims' Counsel, Defense Services, the SARC and the SEEM Manager preventing future harm to victims by ensuring the proper procedures are implemented and followed and that justice and adverse actions are administered properly . Assignments include some of the most diverse, complex, difficult, and novel legal issues found in the emerging area of victims' right law and is responsible for the formulation of state/territory legal policy and its execution in the area of sexual assault accountability, prevention, and response; sexual harassment; domestic abuse and lines of duty and medical discharges for Army and Air personnel. Responsible for advising and providing legal sufficiency reviews of senior leaders' messages of sexual assault and sexual harassment prevention methods in formal and informal settings and the review of any implementation of DoD policy or guidance related to competencies leaders must have related to overseeing prevention. Advise on the legal, factual, and other impacting aspects of drafting, interpretation and application of legislation, regulation, tasking orders, decision, opinions or other guiding, or lack thereof, instruments associated with emerging or highly conflicted, sensitive and emotionally charged issues relating to sexual crimes, harassment, domestic violence/abuse, and to the prevention and response of sexual crimes, harassment, and domestic violence/abuse. Serves as legal counsel to senior leaders on legislation, regulation, or guidance as to creating protective environments and promoting healthy social norms specific to military communities, which can include advising on any collaborations with local, state, federal partners and/or other industry that can ensure that the military can evaluate and assess the impact of their community-level prevention strategies both in the short and long-term. Conducts outreach on behalf of the organization to legal entities and organizations, including State Bar, and statewide civilian organizations who support victims, and conducts training to the organization and leaders regarding legalities/requirements in addressing prevention and response of special crimes, domestic violence, and sexual assault. Represents the ND National Guard in all legal matters in state/territory of original or appellate jurisdictions, to include matters pertaining to sexual crimes, sexual harassment, and domestic violence/abuse. Advise on any fiscal contracts that address DoD policy and programs aimed at integration and implementation of the prevention workforce programs. Represents the ND National Guard as a trial attorney on all sexual assault, sexual harassment and domestic violence cases, administrative judges and arbitrators from various appellate bodies. Develops training plans and materials and conducts training, education and outreach to leadership and the organization, local civilian victims' organizations, state bar associations, law enforcement agencies, county prosecutors' offices, and other state resources on the Integration of Primary Prevention Workforce programs. Candidates' experience should be evaluated on the basis of duties performed rather than strictly on the rank of the individual; however, established compatibility criteria/assignments must be followed. The applicant's record of experience and/or training must show possession of the knowledge, skills and abilities needed to fully perform the duties of the position. In order to qualify for the Attorney-Advisor (General) position, you must meet the following minimum qualifications: Education: applicants must possess a LL.B or a J.D. degree AND Licensure: Applicants must be an active member of the bar (any U.S. jurisdiction) in good standing, duly licensed and authorized to practice law as an attorney under the laws of any U.S. state, territory of the U.S., or the District of Columbia. (Provide the month and year in which you obtained your first license and the State from which it was issued. AND Required Experience: Applicants must have two full years of post J.D. (or equivalent) legal or other relevant experience. This experience includes: 1) conducting legal research in connection with cases pending administrative hearings, trials before courts of original jurisdiction, or arguments in appellate courts; 2) Addressing questions regarding the effects of provisions of proposed legislation or proposed changes in agency policies or regulations; preparing legal documents or advisory opinions, participated in contract negations, and examined documents for legal sufficiency; and providing legal interpretation and guidance to managers and senior leaders regarding Federal, State, and Military laws and policies. Part-time experience: Credit will be given for appropriate unpaid work on the same basis as for paid experience. Part-time experience will be credited on the basis of time actually spent in appropriate activities. To receive credit for such experience you must indicate clearly the nature of the duties and responsibilities in each position held and the number of hours per week spent in such employment. Education Education must be accredited by an accredited institution recognized by the U.S. Department of Education in order for it to be credited towards qualifications. You MUST provide transcripts or other supporting documentation to support your educational claims.
