    THE POSITION

    The Pennsylvania Department of Labor & Industry's Bureau of Labor Law Compliance is actively looking to fill the role of Bilingual Labor Law Investigator, a position dedicated to upholding and enforcing the state's labor laws that safeguard the rights of workers. In this vital role, the investigator will engage in a variety of responsibilities aimed at educating both employees and employers about Pennsylvania's labor regulations through comprehensive public education initiatives. Additionally, the investigator will conduct thorough inspections and investigations to ensure compliance, mediate disputes that arise, and, when necessary, initiate legal action against employers who fail to rectify violations through administrative means.     DESCRIPTION OF WORK

    This role encompasses a variety of responsibilities aimed at ensuring compliance and addressing grievances. The individual in this position is tasked with receiving and evaluating complaints, conducting thorough audits of payroll records, timecards, and associated documentation. When necessary, they facilitate discussions between claimants and employers to resolve issues amicably. In cases where legal action is warranted, the role involves filing prosecutions and preparing comprehensive case narratives, which include both written documentation and verbal testimony for court proceedings.

     

    Additionally, the position requires educating contractors, organizations, employees, and public officials about legal requirements and recent judicial rulings that impact the enforcement of these laws. The individual must also gather relevant documents and information from various stakeholders to support audits and investigations, while meticulously preparing detailed reports on their findings. Regular communication with employers, employees, and supervisors regarding the status of ongoing investigations is essential.

     

    Furthermore, the representative acts on behalf of the Commonwealth in legal proceedings, providing expert testimony during administrative and court hearings. The role includes the collection of physical evidence and eyewitness accounts to bolster prosecution efforts, as well as conducting timely interviews with claimants and business owners, either over the phone or in person. Inspections of businesses or projects are conducted to identify potential violations related to the employment of minors, which may involve discussions with school district officials, project managers, company representatives, and parents or guardians. The position requires travel to various business locations for investigation and audit purposes, while maintaining detailed and timely notes on case progress. Finally, the individual is expected to consult with their supervisor regarding complex cases to ensure thorough and effective handling of all matters.

    Work Schedule and Additional Information:

    + Full-time employment, home headquartered

    + Work hours are 8:30 AM to 5:00 PM, Monday - Friday, with a 60-minute lunch.

    + May require frequent travel to the Scranton District Office for training during the first few months.

    + This position is home headquartered. In order to be home headquartered, you must have a securely configured high-speed internet connection and work from an approved location inside Pennsylvania.

    REQUIRED EXPERIENCE, TRAINING & ELIGIBILITY

    QUALIFICATIONS

    Minimum Experience and Training Requirements:

    + Two years of technical investigative or construction and trades experience and an associate's degree in a field related to investigative or construction and trades work; or

    + One year of technical investigative or construction and trades experience and a bachelor’s degree; or

    + An equivalent combination of experience and training.

    Additional Requirements:

    + This position requires you to possess and maintain federally compliant identification such as a U.S. Passport, REAL ID, or Military ID. Proof of possession will be needed at the time of a conditional offer of employment.

    + The ability to fluently speak and write in Spanish in required.

    + You must live in or be willing to move to the geographic region the Scranton District Office covers by date of hire. Expenses will not be paid. Counties include: Berks, Bradford, Bucks, Carbon, Columbia, Lackawanna, Lehigh, Luzerne, Monroe, Montour, Northumberland, Northampton, Pike, Schuylkill, Snyder, Sullivan, Susquehanna, Union, Wayne, and Wyoming.

    Preferred Qualifications (not required):

    + Experience in conducting investigations or working in construction and trades, business management, financial services, accounting, or conflict resolution

    + An associate's degree or greater, in a field related to investigative work in construction and trades, business management, financial services, accounting, or conflict resolution

    + Experience enforcing labor standards or labor and employment laws

    + Experience testifying at administrative or court hearings
