Description

We are looking for an experienced Attorney to join our team in the Buckhead area of Atlanta, Georgia. This role focuses on managing legal matters related to liens, personal injury litigation, and bankruptcy law. The ideal candidate will play a pivotal role in advising clients and ensuring their best interests are represented in complex legal scenarios.

Responsibilities:

• Develop and implement strategic approaches to manage liens in personal injury cases, factoring in the interplay with bankruptcy law and dischargeability.

• Provide expert guidance to clients on the impact of bankruptcy on personal injury claims, including potential implications of automatic stays and discharge effects.

• Negotiate with lienholders to resolve or reduce liens, and litigate disputes concerning lien validity and priority in both personal injury and bankruptcy courts.

• Represent clients in bankruptcy court proceedings, including seeking relief from automatic stays and objecting to lien claims when necessary.

• Structure settlements in personal injury cases to address and satisfy valid liens while safeguarding the client's interests against bankruptcy-related risks.

• Oversee the proper distribution of settlement funds, ensuring compliance with legal requirements and protection of client interests.

• Analyze and advise on the intersection of bankruptcy law with personal injury claims to develop comprehensive legal strategies.

• Collaborate with stakeholders to ensure all lien-related and bankruptcy matters are handled efficiently and effectively.

Requirements • Proven experience in managing liens within personal injury litigation and bankruptcy cases.

• In-depth knowledge of bankruptcy law, including automatic stay and dischargeability provisions.

• Strong negotiation skills with lienholders to achieve favorable resolutions.

• Ability to litigate lien disputes and priority issues in court.

• Expertise in structuring settlements to address legal and financial complexities.

• Exceptional analytical skills to assess the impact of bankruptcy on personal injury claims.

• Licensed attorney with relevant jurisdictional qualifications.

• Strong communication and representation skills in court settings.
